Yes, foreigners can divorce in China when a China connection supports jurisdiction (typically residence, a China-registered marriage, a Chinese spouse’s domicile, or related statutory links). If both spouses fully agree on divorce, children, property and debts, and the local marriage-registration office will take a foreign-related file, you may use the registration path (Civil Code Arts. 1076–1078), including the national cooling-off sequence. Otherwise either spouse may sue (Art. 1079). Cooling-off is not a court stay. A Chinese divorce does not automatically work worldwide or extend a dependent visa.

Scope and legal framework
This page is for a foreign national (or two foreigners) who can still treat China as a live forum. It covers acceptance, the two statutory routes, documents, time and cost. Children, property and foreign recognition have their own spokes.
Civil Code Arts. 1076–1078. Spouses who both wish to divorce may apply for divorce registration when they have reached the required arrangements. A cooling-off period applies to that registration application. Either spouse may withdraw. If they do not complete the later step, the application lapses.
Civil Code Art. 1079. Where one spouse wants a divorce or the registration path is not available, a people’s court may grant divorce if the relationship has broken down. The court also decides children, support and property when the parties cannot agree.
Marriage Registration Regulations (State Council Order No. 804, 2025). Change how and where some couples may register marriage or divorce. They do not, by themselves, make every mixed-nationality couple eligible for administrative divorce.
Civil Procedure Law (foreign-related provisions). Venue, service, language of the court and evidence formed abroad. This is usually why a “simple” foreign-related case is not simple.

Common mistakes
- Assuming civil affairs will take the file because both of you are “fine with it.”
- Applying cooling-off language to a lawsuit.
- Bare POA signed abroad without notary and apostille.
- Using visa status as leverage or assuming the court will freeze immigration.
- No plan for the decree abroad or for China property — those are other pages, not afterthoughts.
