Use the court that can actually reach the child this month, and do not assume a Hague return application will land on a mainland desk. A Chinese court with jurisdiction applies Civil Code Article 1084 and the child’s interests — not a worldwide return chapter China did not join. Long-term custody follows the child’s settled life (school, caregivers, time on the ground). A single-country order often fails at the other school or border. Dual counsel is the default. Scope and legal framework
This page is about children with a mainland or SAR connection. Divorce process, property and decree recognition are other spokes. The 1980 Convention is about prompt return / access between contracting states, not a worldwide custody trial.
Civil Code Art. 1084. After divorce, parents still have the right and duty to raise, educate and protect the child. The child’s interests come first. A child under two is generally placed with the mother, subject to exceptions.
Civil Code Arts. 1058 and 1085. Parents share the duty to raise children. After divorce the non-custodial parent typically pays support.
Law on the Protection of Minors. Welfare overlay for schools, guardianship and institutions that will actually obey an onshore order.
1980 Hague Child Abduction Convention. Civil cooperation among contracting states for return and access. Mainland China is generally not a contracting state as of the August 2026 editorial check. Re-verify on official HCCH listings.
Practical workflow
Orders that can travel
Write decision-making, residence, holiday travel, and who holds which passport. Then ask the other country’s counsel how to register or mirror the order. A Shanghai judgment that a foreign school will not read is not protection. Pair with what to document now.

A dual-national child had four school years in Shanghai. One parent moved toward relocation without a consent order. Counsel filed promptly for interim parenting and passport controls in the competent Chinese court; foreign counsel watched a parallel filing risk. The later plan used defined holidays and notarized consent letters. The lesson is early dual-track paper, not that every case settles.
