You can often file in the country where you now live, and you can often still file in (or be sued in) a Chinese people’s court when statutory links exist — typically the Chinese spouse’s domicile, the place of marriage registration, or other foreign-related venue rules. The useful question is not “which court is easier,” but which paper will work where the child, the house and the bank live. A foreign default against a spouse who never saw lawful service rarely moves a China register. Parallel filings are a failure mode. You do not need to fly to every hearing if the POA and service chain are done properly.

Scope and legal framework

Civil Procedure Law (foreign-related jurisdiction and service). A Chinese court may hear a foreign-related divorce when statutory connecting factors are met. Service on a person in China, or on you abroad, must follow lawful channels. Informal WeChat delivery is not a substitute.

Civil Code Art. 1079. Once a Chinese court has the case, contested divorce and the breakdown test are the same merits rules as for an in-China filer.

Apostille Convention. A POA or foreign public document often needs apostille (or residual consular legalization) plus Chinese translation before a PRC court will let counsel appear.

Country A private international law. Whether your home court will take the case, stay it, or ignore a later Chinese judgment is a local-counsel question. Do not import a US lis pendens rule into a Chinese courtroom.

Get both lawyers on one timeline of hearings, interim parenting orders and recognition risk before the next sitting. Racing the second court is how families buy two inconsistent orders.
