Yes. Prenuptial and postnuptial property agreements are valid in China if they are in writing, voluntarily signed, and lawful. The live rule is Civil Code Article 1065 (not repealed Marriage Law Article 19). Couples may agree that premarital and marital property is separate, joint, or mixed. The agreement binds the spouses. It does not automatically bind good-faith creditors, it does not decide child custody or child support, and a foreign prenup is not self-executing against China-sited title. Notarization is strongly recommended for proof, but it is not a universal statutory filing step at the marriage registry.

Scope and legal framework
China does not use the common-law “prenup” brand as a separate statute. The instrument is a 夫妻财产约定 — a written agreement on ownership of premarital property and property acquired during marriage. Prenups and postnups sit on the same article.
Civil Code Art. 1065. Husband and wife may agree in writing that property acquired during the marriage and premarital property shall be owned separately, jointly, or partly separately and partly jointly. The agreement is legally binding on both parties. Where they agree on separate ownership, a debt of one spouse is that spouse’s personal debt as against a third party who knows of the agreement.
Civil Code Art. 1062. Default joint property includes wages and bonuses, proceeds of production, business and investment, proceeds of intellectual property, and inheritances or gifts except those determined to belong to one spouse only.
Civil Code Art. 1063. Separate property includes premarital property, compensation for personal injury, property determined by will or gift to belong to one spouse, and articles for daily personal use.
Civil Code Art. 1064. Debts incurred in both names, or used for family daily life, are generally joint. A private allocation between spouses does not, by itself, defeat a good-faith creditor.
Civil Code Art. 1087. On divorce, joint property is divided by agreement first. If the parties cannot agree, the court divides it according to the specific facts, taking care of the children and the wife’s rights and interests.

- Replace real-estate registration or company-register formalities

Practical workflow
There is no single national “prenup filing clock.” Treat the work as a closing: disclosure, regime choice, bilingual text, execution, then alignment of title and cap tables.
Cross-border execution notes
- Chinese + foreign spouse. Draft in Chinese and the other spouse’s language. Use a sworn or certified translator. Independent advice for each side is the cleanest consent story.
- Two foreigners marrying in China. You can still sign a China-facing agreement for China assets. Home-country counsel or a consular notary may be needed if the same paper must travel.
- Sign before civil marriage registration if you want a true prenup. After the marriage certificate, use a postnuptial / marital property agreement on the same article.
- Do not skip title work. If the deal is “this apartment is A’s alone,” keep the register consistent. If the deal is a gift of a share to B, complete registration or notarization — a promise to “add a name later” can be revoked as a gift.
Common mistakes
- Citing the wrong statute. Marriage Law Article 19 is historical. Use Civil Code Article 1065.
- Oral or WeChat “we agreed.” The writing requirement is strict for a regime the court will apply.
- Signing on the wedding morning. Creates a coercion / surprise narrative even if the words are fair.
- Hiding assets or debts. Concealment is a classic path to partial or full invalidity and a worse divorce split.
- Extreme forfeiture clauses. “Leave with nothing if you file” is routinely treated as contrary to public order or fairness.
- Treating a foreign prenup as China title. The register and Art. 1062 still decide a lot of China cases.
- Commingling after a clean separate-property clause. Joint accounts and marital mortgage pay-down reopen the fight.
- Calling a gift a prenup. “I will put your name on the deed after we marry” is often a revocable gift until registration or notarization.
Action checklist
- List China nexus: nationality, residence, marriage venue, China title, China income, likely court.
- Build a signed disclosure schedule (real estate, accounts, equity, IP, debts, guarantees, parental money).
- Choose the Art. 1065 menu: separate, joint, or mixed — including income and new purchases.
- Write the premarital-home rule: waiver, priced compensation, or defined share of appreciation.
- Separate “regime” sentences from “gift of this house” sentences.
- Prepare Chinese + other language texts with a prevailing-language clause.
- Each party gets independent legal advice; keep the engagement letters.
- Leave cooling-off days; do not sign at the banquet.
- Notarize where practical; video the signing if a notary is unavailable.
- Align the real-estate register, bank mortgage files, and company records with the paper.
- If a foreign prenup already exists, commission a consistency memo — do not leave two contradictory regimes.
- Diary amendment triggers: refinance, parental transfer, equity grant, immigration change.
- Update wills and beneficiary designations in the same sitting.
