Environmental compliance for a factory in China is a project-lifecycle system, not a single permit. Before construction or a production-line change, the operator must classify environmental impact assessment requirements. Before discharging pollutants, it must determine whether key permit management, simplified permit management or pollutant-discharge registration applies.

This guide maps the national framework for foreign-invested manufacturers: EIA, discharge permits, hazardous waste, monitoring, inspections, incidents, transaction diligence and the national carbon market. Industry catalogues, technical specifications, local standards and site-specific approvals must be checked for each facility.

The Environmental Protection Law is the framework statute, supported by laws and regulations addressing environmental impact assessment, air, water, soil, solid waste, noise, pollutant-discharge permits and environmental information disclosure. A business licence does not replace project or operating approvals.

Environmental impact assessment before construction

Construction projects with environmental effects are classified under the current construction-project EIA catalogue. Depending on the nature and degree of likely impact, the project may require an environmental impact report, an environmental impact report form, or an environmental impact registration form. Reports and report forms follow the applicable approval route; registration forms follow the filing route.

Complete the classification before construction. The project description should match the real site, products, capacity, processes, raw materials, pollutants and treatment facilities. During construction, implement the environmental measures in the EIA document and approval. Before expansion, relocation, a new production line or a material process change, reassess whether a new approval, filing or other procedure is required.

An acquired facility should not be treated as compliant merely because it has operated for years. Compare the approved project with actual production and identify unapproved construction, capacity drift, missing acceptance work and permit mismatch.

Pollutant-discharge permit lifecycle

The discharge-permit regime uses classified management. Facilities within the applicable catalogue may be subject to key management, simplified management or discharge registration. Classification depends on the industry, production process, pollutants and environmental impact; it cannot be determined from company size or foreign-invested status alone.

  1. Scope: map every production unit, outlet, fugitive source, pollutant, concentration, volume and destination.
  2. Application or registration: reconcile the application with the EIA record, total-emissions controls and relevant technical specification.
  3. Operation: run and maintain pollution-control facilities and keep actual discharge within permit conditions and standards.
  4. Monitoring and records: carry out self-monitoring, maintain environmental-management ledgers and retain source data.
  5. Execution reporting and disclosure: submit required permit execution reports and publish information applicable to the facility.
  6. Change and renewal: assess changes promptly. A new or expanded polluting project or changes to outlets, methods, destinations, pollutants or authorised amounts may require reapplication rather than a simple internal update.

Permits are site-specific. A company with multiple production locations should assess each location separately. Do not rely on a vendor's environmental report without comparing it to the national permit platform, the physical facility and underlying monitoring data.

Hazardous-waste controls under the 2025 Catalogue

Start with waste generation, not disposal invoices. Identify each waste stream, source process, composition and hazardous characteristic against the 2025 National Catalogue of Hazardous Wastes and applicable identification standards. Where the status is uncertain, use the legally required identification route rather than relabelling the material as a by-product.

  • Maintain a current hazardous-waste management plan and generation ledger where required.
  • Use compatible containers, labels, segregated storage and controls for leakage, fire and incompatible materials.
  • Record quantities from generation through storage, transfer, utilisation or disposal.
  • Verify transporter and receiving-facility qualifications, permitted waste codes and capacity before transfer.
  • Use the applicable electronic transfer-manifest and approval processes, including cross-region requirements.
  • Investigate inventory discrepancies and retain contractor diligence, weighing, manifests and final-receipt evidence.

An exemption in the 2025 Catalogue applies only to the specified management stage and conditions. It should not be converted into a general statement that the material is unregulated.

Operating controls, inspections and incidents

  • Reconcile EIA, permit, facility drawings and actual operations after every material change.
  • Protect monitoring-system integrity, calibration records, raw data and access logs.
  • Track local and national discharge standards, special control periods and total-emissions limits.
  • Maintain complaint, abnormal-operation, bypass, spill and corrective-action registers.
  • Train EHS-critical roles and give a named manager authority to halt non-compliant operation.
  • Test environmental emergency plans, contacts, containment equipment and regulator-notification workflows.

During an inspection, verify authority, designate a response team, preserve records and document samples and requests. Do not obstruct access, alter monitoring information or reconstruct ledgers. If an incident occurs, protect people and the environment, stop continuing releases where safe, preserve evidence, follow applicable reporting duties and coordinate technical, legal, insurance and customer responses.

Environmental due diligence for acquisitions and suppliers

Environmental diligence should test legal status against the physical facility. For an acquisition, use the China M&A due-diligence hub for transaction process and apply this environmental workstream:

  • site history, land-use compatibility, soil and groundwater concerns;
  • EIA documents, approvals, filings, acceptance and actual project configuration;
  • discharge permit or registration, monitoring, ledgers, execution reports and public disclosures;
  • hazardous and general waste streams, storage, manifests and contractor qualifications;
  • notices, penalties, daily fines, production restrictions, complaints, litigation and remediation;
  • environmental capex, closure obligations, insurance and responsibility allocation;
  • carbon-market inclusion, emissions data, allowances and surrender status where applicable.

For suppliers, convert findings into onboarding conditions, corrective-action deadlines, audit rights, notice obligations and exit rights. A certificate collected once is not an operating control.

China national carbon market

The 2024 Interim Regulation governs the national mandatory carbon emissions trading market. In 2025, national coverage expanded from power generation to include steel, cement and aluminium smelting. Inclusion depends on the applicable sector criteria and the official list of key emitting entities; it is not created merely by operating in a named industry.

An included entity should maintain organisational and installation boundaries, source data, calculation files, internal review, emissions reports, verification responses, allowance records and surrender evidence. Responsibility for data quality cannot be solved by outsourcing calculations to a consultant.

Keep four systems distinct: the national mandatory allowance market, the national voluntary greenhouse-gas reduction market, local carbon-market arrangements and the EU Carbon Border Adjustment Mechanism. Chinese exporters needing the EU mechanism should use the CBAM guide; CBAM reporting does not replace China ETS compliance.

Environmental disclosure and ESG routing

Companies subject to law-based environmental disclosure need accurate records and publication controls.
