Electronic evidence in a Chinese civil or commercial dispute can include messages, email, webpages, account and transaction records, access logs, documents, images, audio, video, digital certificates and software-generated records. The legal question is not whether digital material is evidence, but whether the specific record can be connected to the right person, kept complete and shown to be reliable.

Preservation should retain more than visible content. Keep the native record or original device where proportionate, associated metadata and attachments, account-identity evidence, the surrounding conversation, collection notes and a stable verification copy. Screenshots can help explain a record, but a cropped image alone often leaves avoidable disputes about source, completeness and alteration.

Direct answer

Preserve electronic material in a way that lets the court reconstruct who created it, when, through which system, what the complete content was and whether it changed. Start with a defensible native collection, create a working copy, record each transfer or conversion, and present a readable Chinese-language hearing set tied back to the source.

No single technique guarantees acceptance. Notarization, timestamps, hashes, trusted platforms, electronic signatures and blockchain records can strengthen particular links in the chain, but the court still evaluates authenticity, legality, relevance and probative force on the whole record.

What counts as electronic data

The SPC Evidence Provisions include information published through webpages, blogs and social platforms; communications such as text messages, email, instant messages and group chats; registration, authentication, transaction, communication and login records; and digital files such as documents, images, audio, video, certificates and programs. Other digitally stored, processed or transmitted information capable of proving case facts may also qualify.

Do not classify evidence only by what appears on screen. A printed email may be an output of electronic data, while server logs, headers and account records may prove identity and integrity. Preserve all relevant layers.

Collection plan

Issue a focused legal hold when a dispute is anticipated. Identify custodians, devices, business systems, personal accounts used for work, cloud services, platform retention periods and automatic deletion. Stop routine deletion where lawful and proportionate.

Collection should respect privacy, employment, cybersecurity, data-security, state-secrets and sector rules. Access rights do not automatically authorize unlimited review. Define scope, minimize unrelated personal material, preserve access logs and document who performed the collection.

Native files, metadata and original form

For electronic data, the evidence rules require an original, but recognize specified copies or directly derived printouts and other outputs that accurately display and identify the data as originals. Preserve the source system or device where feasible and explain how an export or output was generated.

Keep message identifiers, timestamps, sender and recipient fields, email headers, attachments, file properties, audit logs and relevant time-zone information. Avoid opening and resaving a file in a way that changes metadata. Calculate hashes where useful, record the tool and time, and retain a read-only preservation copy.

Identity and attribution

A username, avatar or email display name does not by itself prove who acted. Connect the account to the person or company through registration and verification information, phone or email linkage, prior communications, payment records, device possession, business role, address books, admissions and consistent conduct.

Separate account ownership from authorship and authority. A company account may have several operators; an employee may send a genuine message without authority to bind the company. The evidentiary and substantive questions should be analyzed independently.

Completeness and context

Export the full relevant conversation rather than selected favorable lines. Preserve replies, recalled or deleted-message indicators, attachments, voice messages, linked documents and the surrounding period needed to understand the exchange. Record the collection path from the live account to the submitted exhibit.

Where a platform does not offer a usable export, use screen recording or another documented capture that shows account navigation, identifiers, dates and continuity. Keep the device available if proportionate and obtain third-party records or preservation assistance before retention expires.

Authenticity factors

The evidence rules direct courts to consider the reliability and normal operation of the hardware and software environment; safeguards against error; completeness and reliability of storage, transmission and extraction; whether records arose in ordinary activities; who preserved and extracted them; and other integrity factors.

Records adverse to the submitting custodian, records provided or confirmed by a neutral third-party platform, ordinary-business records, archived records and data kept by an agreed method may receive a favorable authenticity assessment unless rebutted. These are not substitutes for relevance or proof of the underlying proposition.

Electronic signatures and contracts

Chinese law does not deny legal effect solely because information is in electronic form. A reliable electronic signature can have the same legal effect as a handwritten signature or seal when the statutory reliability conditions are met. Examine control of signature-creation data, ability to detect later alteration, the certificate chain, identity verification and the transaction record.

A signature platform report helps, but the full file should include the executed document, audit trail, certificate or verification material, delivery evidence and account identity. Also determine whether law or party agreement requires another form for the transaction.

Platforms and third parties

Move quickly where important data is held by a messaging, ecommerce, payment, logistics, cloud or signing platform. Preserve what the client can access, identify the legal entity operating the service, and assess a court investigation, production or evidence-preservation application.

A platform-generated export may be stronger than a manual transcription, but ask what the platform actually confirms. Custody, account identity, timestamp, content and transaction completion are separate propositions.

Notarization, timestamps and blockchain

Notarial preservation can document what a notary observed and can support authenticity under the evidence rules, subject to contrary evidence. It does not guarantee that a speaker told the truth or possessed authority. Use a method suited to the source and preserve the underlying native data where possible.

A trusted timestamp or blockchain record can help show that particular data existed and has not changed since a point in time. Courts still examine the data before it was recorded, the storage process, technical verification and other evidence. Blockchain does not automatically make uploaded content authentic.

Court preservation and hearing presentation

If data may disappear or cannot be obtained later, consider a targeted evidence-preservation application. Identify the account, system, date range, custodian, risk and proposed method. Avoid an overbroad request that captures unrelated or protected data.

For the hearing, provide a readable exhibit with Chinese translation where needed, plus a source note identifying the device or system, collector, date, method, file names, hashes and any transformations. Be ready to demonstrate the source or verification process and answer challenges to identity, completeness and legality.

Preservation checklist

  1. Identify custodians, systems, accounts, devices and retention periods.
  2. Suspend relevant deletion through a lawful, proportionate hold.
  3. Collect native data, metadata, attachments and context.
  4. Preserve account-registration and operator evidence.
  5. Record the collector, method, tool, time and each transfer.
  6. Create stable verification and working copies.
  7. Obtain platform or third-party confirmation where useful.
  8. Evaluate notarization, timestamping, appraisal or court preservation for the specific risk.
  9. Prepare Chinese translations and a source-linked exhibit index.
  10. Test identity, integrity, legality, relevance and the fact actually proved.

Common mistakes

  • Treating screenshots as automatically inadmissible or automatically sufficient.
  • Saving visible messages but losing attachments, headers and account details.
  • Assuming account ownership proves authorship or authority.
  • Collecting from personal devices without a lawful, scoped process.
  • Believing notarization or blockchain proves the truth of content.
  • Converting or resaving files without recording metadata changes.
  • Waiting until the platform’s retention period expires.
