A police or traffic matter in China can generate several legally different records: an administrative penalty, an administrative compulsory measure, a traffic-violation score, a decision concerning seized or recovered property, an accident-liability determination, or a criminal case. The available challenge and filing clock depend on the document actually issued, not merely on the incident description.

The framework changed recently. The revised Public Security Administration Punishments Law took effect on January 1, 2026, while the revised regulation implementing the Administrative Reconsideration Law took effect on July 1, 2026. Anyone considering a challenge should preserve the decision, delivery record and enforcement evidence immediately and verify whether reconsideration, administrative litigation or another procedure applies.

Classify the decision before choosing a remedy

Public-security enforcement and road-traffic enforcement can overlap, but they are not one procedure. Start by identifying the issuing authority, document title, legal basis, operative result, date of service and current enforcement status.

  • Public-security administrative punishment: examples can include a warning, fine, administrative detention or revocation of a permit issued by a public-security organ.
  • Related public-security decision: confiscation, recovery, or a restrictive or prohibitory measure may carry its own review route.
  • Traffic administrative measure or penalty: examples include a fine, licence-related measure, vehicle or document detention, or another decision by a public-security traffic-management department.
  • Traffic-violation points: identify the underlying violation decision and the separate rules governing points and licence administration.
  • Traffic accident record: an accident-liability determination, civil compensation dispute and administrative penalty should not be treated as the same act.
  • Criminal process: criminal detention, bail, investigation and prosecution are governed by criminal procedure, even if the same conduct first came to police attention as an administrative matter.

Public-security punishment decisions

The revised Public Security Administration Punishments Law was adopted on June 27, 2025 and took effect on January 1, 2026. Article 121 states that a punished person or an injured party who disagrees with specified public-security punishment decisions, confiscation or recovery decisions, or relevant restrictive or prohibitory measures may apply for administrative reconsideration or bring administrative litigation according to law.

The written punishment decision should state the facts and evidence, type and basis of punishment, method and period of execution, and the route and period for reconsideration or litigation. Preserve every page and the proof of delivery. For an on-the-spot decision, preserve the contemporaneous decision and any available audio, video, payment or incident record.

Traffic enforcement decisions

The Road Traffic Safety Law and the Ministry of Public Security's Road Traffic Safety Violation Handling Procedures provide the operating framework for many road-traffic measures and penalties. The current procedure rules were materially amended by Ministry of Public Security Order No. 157, effective May 1, 2020. They recognize the right to seek administrative reconsideration or administrative litigation against administrative compulsory measures or administrative punishment decisions.

For camera or other non-on-site enforcement, collect the full violation record rather than relying on an abbreviated app screen. Relevant material may include the location, time, images or video, notice history, vehicle and driver attribution, applicable sign or restriction, processing record and final penalty decision. A request to correct raw platform data and a legal challenge to a final administrative decision may be distinct steps.

Deadlines and forum

The ordinary period for an administrative reconsideration application is generally 60 days from when the applicant knew or should have known of the administrative act, unless another law provides a longer period. The revised law contains qualifications where the authority did not give the required notice, where a statutory duty was not performed, or where force majeure or another proper reason caused delay. Administrative litigation has its own statutory periods and procedural rules.

Do not calculate time only from the day a fine was paid or an online account was checked. Service may occur in person, by post, electronically or through another lawful mechanism. Record the first notice, final decision, actual access to electronic materials and each submission date.

The competent reconsideration organ depends on the body that made the challenged act and the current jurisdiction rules. A traffic police unit, public-security bureau, dispatched body and jointly acting authority may require different analysis. Check the rights notice on the decision, then verify it against the current Administrative Reconsideration Law and its 2026 implementing regulation.

Build the evidence file

A useful review file normally separates procedural and substantive questions:

  • the complete decision, notice and proof of service;
  • the legal provisions cited by the authority;
  • identity, vehicle, licence or entity records relevant to standing;
  • original photographs, video, device records, location data and witness information;
  • records of statements, defence submissions, hearings and authority responses;
  • receipts, property inventories and documents concerning seizure, confiscation or recovery;
  • a chronology distinguishing investigation, proposed action, final decision and execution; and
  • documents showing any related civil or criminal proceeding.

Preserve original metadata where available. Avoid editing the only copy of a video or screenshot. If evidence is held by the authority, identify it precisely in the application and consider the procedural route for requesting review of that material.

Execution is a separate question

Starting reconsideration or litigation does not automatically suspend every administrative act. The applicable statute provides circumstances in which implementation may be suspended. Administrative detention has additional statutory rules. Under the revised Public Security Administration Punishments Law, a person challenging administrative detention may request temporary suspension in specified circumstances; public-security authorities assess social-danger considerations and statutory security requirements.

Never assume that paying a fine, surrendering a document, providing security or requesting suspension determines the merits. Record what was done, under which document, and whether any right was expressly reserved.

Possible outcomes and connected proceedings

Administrative reconsideration can result in maintenance, modification, revocation or partial revocation, confirmation of illegality or invalidity, an order to perform a duty or take a new act, or rejection of the application or requested relief, depending on the legal and factual findings. An administrative court uses the separate framework of the Administrative Litigation Law.

A successful administrative challenge does not automatically resolve private compensation after a traffic accident, recover every loss, or determine a criminal case. Map each desired outcome—removal or alteration of a penalty, return of property, correction of a record, suspension of detention, civil compensation or defence in a criminal process—to its proper procedure.
