Public procurement disputes in China begin with classification. A purchase governed by the Government Procurement Law does not always follow the same challenge route as an engineering project governed by the Bidding and Tendering Law. The purchaser, funding, object, procurement method and procedural stage determine the controlling regime, authority and deadline.
Before asking questions or challenging an award, preserve the notice, procurement or prequalification documents, amendments, bidder questions, submission receipt, complete bid, opening and evaluation records available to you, award notice, debriefing, correspondence and proof of when each document was received. Short working-day deadlines make early classification essential.
Subject to editorial and legal review. Procurement documents, sector rules and local procedures may impose additional requirements. Obtain matter-specific advice before a challenge deadline expires.
Classify the procurement regime
Identify the purchaser and whether fiscal funds are used for goods, services or works within the applicable catalogue or threshold. Government procurement generally follows the Government Procurement Law and its implementing regulation. Government-procurement construction using tendering can fall under the Bidding and Tendering Law and its implementing regulation; other construction procurement methods may remain under the government-procurement regime. State-owned-enterprise purchasing is not automatically government procurement, although mandatory tendering, internal rules or sector supervision may apply.
Map the method, stage and authority
Record whether the process uses open or invited tendering, competitive negotiation, competitive consultation, single-source procurement, inquiry or another authorized method. Identify the purchaser, procurement agent, evaluation body, finance department, development and reform authority, sector supervisor and trading platform. A complaint sent to the wrong body may not protect a deadline.
Review qualification and procurement documents
Test supplier conditions, technical and commercial requirements, scoring factors, samples, certifications, performance history, consortium rules, subcontracting and conflict restrictions against the governing regime. Procurement requirements should relate to the contract and should not improperly exclude or discriminate among suppliers. Seek clarification without changing the substance of the bid or disclosing protected information.
Domestic-product rules from 2026
The State Council's domestic-product policy took effect on January 1, 2026. It establishes a China-production standard, component-cost methodology and declaration mechanism, with staged component and key-process requirements. Purchasers and suppliers should preserve manufacturing, accounting, component and declaration evidence. Foreign-invested enterprises receive equal treatment for qualifying products, but a false declaration can trigger procurement-law consequences.
Bid preparation and integrity controls
Build a compliance matrix against every mandatory condition and scoring item. Control seals, signatures, authorization, pricing, bid security, validity, electronic upload and encryption. Verify the accuracy of licences, certificates, personnel, experience and product-origin statements. Prevent coordination with competitors, bid rotation, cover bids, shared pricing, improper contacts and use of another entity's qualifications.
Evaluation, award and contract formation
Evaluation must apply disclosed criteria. Preserve anomalies such as undisclosed factors, inconsistent correction of errors, unequal clarification, unexplained score differences, conflicts, abnormal low prices or a result inconsistent with mandatory conditions. After award, the contract should reflect the procurement and winning response; material departures can create procurement and performance risk.
Government-procurement questions and complaints
Under the Ministry of Finance challenge rules, a supplier generally raises a written question with the purchaser or agent within seven working days after it knew or should have known that its rights were harmed. A participant may challenge the procurement documents within the rule tied to obtaining them or expiry of their notice period. If dissatisfied with the response, or if no timely response is issued, the supplier may generally complain to the competent finance department within fifteen working days after the response period expires. Standing, signature, authorization, requests, facts, legal basis and lawful evidence matter.
Tendering objections and administrative supervision
Bidding-and-tendering objections use different triggers and recipients, including special rules for prequalification documents, tender documents, opening and evaluation results. Some objections must precede an administrative complaint. Identify the competent administrative supervision department and calculate time from the legally relevant publication, knowledge or response date. Do not import the government-procurement timetable into a tender-law matter.
Exclusion, enforcement and litigation
False materials, collusion, bribery, improper influence, refusal to contract and serious performance failures can lead to invalid awards, fines, confiscation, disqualification, adverse records or responsible-person consequences. A finance or supervision decision may support administrative reconsideration or litigation, but those routes do not excuse missed procurement-stage prerequisites. Contract disputes after formation may proceed under the agreed dispute clause while public-law issues remain separate.
