Scope and legal framework

Personal injury in China is not one claim type. Traffic determinations, work-injury recognition, medical appraisal, premises duties and product rules have different first actions, authorities and clocks. Civil Code tort rules sit underneath; Supreme People’s Court interpretations update how those rules apply; local bureaus and courts implement them. This page orients foreign victims, defendants, employers and family representatives. It is not legal or medical advice.

Traffic incident-to-claim map

Police accident determinations are highly influential. They are not always the last word. Parties may challenge them; other evidence, insurance layers and (in serious cases) criminal procedure still matter. Possible compensation categories — proof and locality

Search intent is real. A calculator would be false precision. Recoverable heads can include medical expenses, nursing, nutrition, lost income, disability compensation, death compensation and funeral expenses, dependant issues, emotional distress within recognized limits, and future care. Standards often reference local average income statistics — city of forum matters.

Foreign nationals are not on a separate “expat tariff.” Core frameworks are Chinese law. Proof of income and residence is often more document-heavy. Local averages still often anchor statutory heads.

Insurance and settlement readiness

Insurers are central in traffic and some liability claims. Structured settlements should address future treatment and impairment ratings. Do not sign a broad Chinese or English release you do not understand.

Clock map and civil / criminal overlap

Do not assume a multi-year window for every claim type. Work-injury applications, insurer processes, appraisal and court notices each create their own triggers. Serious traffic offences can run in parallel and change civil strategy; detention after a serious accident may also raise embassy-notification questions. What are possible compensation categories?

Medical and rehabilitation expense, lost income, nursing, nutrition, transport, disability, death, funeral and dependant issues, mental harm within legal limits, and future care. Each needs proof. There is no generic amount on this page.

Why can local statistical standards and appraisal matter?

The 2022 SPC compensation interpretation uses statutory methods plus local statistical standards and specified locality adjustments. Appraisal grades and city of forum can change numbers materially. That is why this page maps proof, not a calculator.

Should I sign an insurer’s release?

Only with eyes open on future treatment, impairment, payment heads and the exact claims, parties and period released — in every language version. Early low offers may not cover later disability ratings. Use the settlement readiness test.

What should I arrange before leaving China?

Record access, original-document custody, translation, insurer / employer / venue contacts, a China service path, a safe communications channel, and a power of attorney if someone must act after you leave. Do not upload identity scans to a public site.

Can a family member or trusted person help manage the claim?

Yes, especially if the injured person cannot act. Confirm authority (guardian, family representative or POA), language needs and a safe contact preference. Keep intake privacy-minimal.

What if the injury also involves a criminal investigation?

Civil and criminal tracks can run together. Detention, serious traffic offences or intentional harm need a specialist civil/criminal handoff. See the criminal defense guide. Do not assume every injury is criminal.

Can I claim if I was partly at fault?

Comparative fault can reduce recovery rather than eliminate it, depending on liability-ratio findings. Evidence of the other party’s negligence still matters.

What if the other driver is uninsured?

Recovery may rely on compulsory insurance mechanisms, the driver’s assets, or other liable parties (for example employers in some scenarios). Early insurance and asset mapping helps. It is not a coverage conclusion.
