A medical, dental or care-facility injury claim in China usually starts with incomplete records and overlapping tracks: clinical negligence, product or blood issues, contract with a private clinic or nursing home, and possible regulatory complaints. The first task is to secure the complete treatment file, identify the provider or facility that owed the duty, and separate the civil claim from any licensing or administrative investigation.
Patients, families and facilities should preserve outpatient and inpatient records, imaging, consent forms, nursing notes, transfer papers, fee invoices and a dated chronology of complaints. This guide provides national civil-claims orientation and does not assess clinical standard of care or likely damages in a particular case.

Secure the records and name the duty-bearer
Request and copy the full medical or dental file immediately, including electronic entries, nursing notes, operative records, prescriptions, test results and informed-consent documents. Identify every hospital, clinic, dental practice, attending clinician, consulting doctor and, for elder care, the facility operator and any outsourced nursing or rehabilitation provider. Civil Code medical-damage rules focus on institutions and their medical staff in diagnosis and treatment; care-facility claims may also engage contract, security-obligation and general negligence theories.
Separate clinical, product and regulatory issues
Not every adverse outcome is actionable negligence. Distinguish ordinary complication risk, alleged fault in diagnosis or treatment, failure to explain and obtain consent, defective drugs or devices, and unqualified practice. Regulatory complaints to health authorities, licence issues and civil damages are different tracks. Healthcare-provider compliance questions belong with the healthcare regulation routes; this topic concentrates on civil liability and evidence needed to prove fault, causation and loss.
Fault, causation and medical appraisal
In ordinary medical-damage claims, the patient generally proves attendance and injury; fault and causation are commonly resolved through medical-damage appraisal under the Supreme People’s Court’s medical-damage interpretation. Courts may allow an appraisal application where the patient cannot otherwise prove fault or causal link. Multiple institutions that contributed to the same harm, external consultations, cosmetic-medical services and defective medical products or blood have specific party and allocation rules in that interpretation. Preserve specimens, imaging disks and device identifiers before they are discarded.
Dental and cosmetic treatment
Dental negligence uses the same medical-damage framework where the dispute arises from diagnosis and treatment. Medical-beauty and cosmetic procedures are expressly brought within medical-damage dispute rules by the interpretation, so “beauty clinic” labelling does not automatically remove the claim from medical-liability analysis. Keep before-and-after records, treatment plans, product batch information and fee contracts.
Elder-care and nursing-facility liability
Nursing homes and care facilities often combine a service contract with duties to protect residents from falls, elopement, pressure injury, medication error, abuse or third-party harm. Depending on the facts, claims may proceed in contract, under security-obligation principles for managers of places providing services, or as general negligence. Preserve admission agreements, care plans, shift logs, incident reports, CCTV requests and notice to family. Where death or catastrophic disability results, use the catastrophic-injury quantum route for the damages package.
Damages, mediation and limitation
Recoverable heads follow the Civil Code and the personal-damages interpretation: medical expenses, nursing, lost earnings, disability or death compensation and, where serious mental harm is proven, consolation. Many disputes are mediated through people’s mediation or hospital complaint channels before suit. Do not sign a broad release before the clinical course and appraisal issues are clear. Watch ordinary civil limitation rules and any shorter contractual notice clauses in private-clinic or care-facility agreements.

- Complete medical/dental/care file and proof of the formal records request.
- Provider, clinician and facility identities, including licences if relevant.
- Consent forms, treatment plans and fee contracts.
