Not every civil injury or property loss in China fits a specialist route. Where the dispute is ordinary fault-based harm to person or property—and is not owned by traffic, medical, product, environmental or another dedicated topic—the starting point is the Civil Code’s general tort rules. The first task is to identify the protected interest, the conduct alleged, causation, the measurable damage and every available defendant.

Claimants and defendants should preserve the damaged property or its valuation evidence, contemporaneous photographs, contracts or custody records, medical notes if personal injury is also claimed, and a dated chronology of the incident and notices. This guide provides national orientation and does not assess fault or quantum in a particular case.

Confirm that this is the residual tort route

Use this route when the claim is general negligence or property damage and no specialist practice owns the analysis. Hand off traffic collisions, medical or care-facility treatment, premises or animal incidents with a clear venue/keeper frame, product defects, environmental pollution, personality-rights or reputation publications, and workplace injury regimes to those topics. The residual route still matters for everyday property damage, ordinary fault between private parties, and mixed claims that need a clean elements checklist before specialist overlay.

Elements: interest, conduct, causation, damage, defendant

Under the Civil Code, a person who through fault infringes another’s civil rights or interests and causes damage generally bears tort liability. Some statutes reverse or remove the fault inquiry; apply those only where the specialised chapter or statute says so. Build the file around five questions: what interest was protected; what act or omission occurred; how that conduct caused the loss; what loss is proven; and who is the proper defendant, including employers, guardians, principals or joint tortfeasors where the facts support them.

Personal injury within a general-tort frame

If the same facts caused bodily injury, the damages package follows the Civil Code and the Supreme People’s Court’s personal-damages interpretation. Severe disability or death should be developed with the catastrophic-injury materials. Do not plead only “property damage” when medical loss, nursing or disability is the main head of recovery.

Property damage valuation

Property loss is generally calculated by the market price at the time of loss or another reasonable method. Preserve the damaged item, repair estimates, replacement invoices, appraisal opinions and proof of ownership or lawful possession. Where the property was in another’s custody, identify bailment, lease, storage or contractor relationships that may allocate risk by contract as well as tort. Avoid discarding the only physical evidence before valuation is agreed or ordered.

Multiple actors, employers and supplemental duties

Joint tortfeasors can attract joint and several liability. Employer liability, contractor/hirer patterns, guardian liability and security-obligation overlays are developed in the Civil Code and tort Interpretation I. Name every actor whose fault or organisational duty may be in play before settling with a single convenient defendant. Releases that omit unknown joint tortfeasors can leave recovery incomplete.

Remedies beyond money

Where an ongoing act endangers person or property, claimants may seek cessation, removal of obstruction or elimination of danger in addition to damages. For completed property loss, repair, replacement cost or diminution in value may all be relevant depending on the asset and proof. Keep settlement drafts clear about whether future-related losses are released.

  • Defendant list, including employers, guardians, managers and joint actors.
  • Photographs, video and custody or ownership documents.
  • Repair estimates, appraisals and proof of pre-loss condition/value.
  • Medical records if personal injury is also claimed.
  • Any contract allocating risk, indemnity or notice duties.
  • Insurance notices and draft releases.
  • Limitation clock and any urgent preservation need.
