A food-safety event in China can trigger immediate stop-sale and notification duties, regulatory investigation, product recall, consumer compensation, platform action and sometimes criminal referral. The first task is to identify the product and batch, producer or commissioning party, distributors and platforms, import chain, affected consumers, test or complaint that raised the concern, and the current containment and reporting status.

Preserve samples under a documented chain of custody, specifications, labels, supplier approvals, production and release records, distribution data, complaints, test results and regulator communications. Do not destroy stock, rewrite production records or delay containment while debating final legal classification. This guide provides national orientation, not a recall or liability decision for a particular product.

Identify the operative rules and transition date

The Food Safety Law and its implementation regulations govern production and operation, standards, inspection, incidents and liability. As of September 11, 2026, the existing Food Recall Measures remain operative. Replacement measures issued by SAMR Order 122 take effect on December 1, 2026. Response plans should comply with today's rules while being ready for the new classification, notice, reporting and completion timetable.

Map the product and responsible operators

Record product name, category, ingredients and additives, special-food status, specifications, production date, shelf life, lot code, licence or filing, producer, commissioning party, importer, distributors, warehouses, retailers, platforms and geographic reach. Confirm which entity caused or controls the risk. Commissioned production does not eliminate the commissioning party's recall role under the incoming measures.

Preventive controls and traceability

Food producers and operators must work under applicable licences or filings, food-safety standards and process controls. Maintain supplier qualification, incoming inspection, production control, release, sanitation, employee health, storage, cold-chain, transport and sales records. Larger or designated businesses must assign food-safety management personnel and use risk-control systems. Traceability should locate affected inputs, finished batches and customers rapidly without over-recalling unrelated stock.

Immediate response to unsafe food

When evidence indicates a product does not meet food-safety standards or may endanger health, stop production or operation, isolate inventory, prevent further distribution, notify the relevant chain and consumers as required, assess reporting, and start recall where the legal test is met. Preserve representative samples and raw electronic data before disposal. Keep the public message accurate: state confirmed facts, affected identifiers and consumer action without minimizing or speculating.

Recall rules today and from December 2026

The current measures require producers and operators to stop unsafe food, notify affected parties, recall and dispose of product, and report as required. From December 1, 2026, recalls will be classified into three levels. The new measures require initiation steps within 24 hours for level one, 36 hours for level two and 48 hours for level three after discovery; planned completion is generally 10, 20 and 30 days respectively, subject to approved extension for complexity. Do not apply those future deadlines as if already in force, but update procedures before commencement.

Recall execution and disposal

A recall plan should identify responsible contacts, exact product and batch, quantities produced and sold, hazard and consequences, recall level where applicable, territory, notices, return channels, cost handling and disposal. Reconcile recovered quantities against distribution. Prevent recalled product returning to market; document correction, harmless treatment or destruction and notify the authority before supervised destruction where required. Label-only remediation is appropriate only when legally permitted and safety remains protected.

Online sales and platforms

Network food sellers must hold and display the required licence or filing, present truthful product and label information, control storage and delivery, and address safety risks. New online-food responsibility rules effective May 20, 2026 require platform verification, risk-control lists, monitoring and action against unsafe listings, while sellers must operate daily control, weekly review and monthly scheduling mechanisms where applicable. Platforms should preserve transaction data and support targeted consumer notification.

Imported food and cross-border coordination

Importers must audit overseas exporters and manufacturers and ensure compliance with Chinese law and national food-safety standards. Check overseas-manufacturer registration, importer records, labels, inspection and quarantine, customs holds and domestic distribution. A China response may need to run alongside a foreign recall, but product identifiers, legal tests, reporting lines and public notices must be localized rather than copied mechanically.

Consumer, regulatory and criminal exposure

Possible outcomes include corrective orders, confiscation, fines, suspension or licence consequences, personal penalties, consumer compensation and punitive-damages claims where statutory conditions are met, platform liability, administrative-credit consequences and criminal referral. Separate regulatory non-compliance from proof that a product caused a particular injury. Preserve causation, purchase, consumption and medical evidence for both claimant and defence analysis.
