A narcotics or gambling allegation in China can move quickly from an administrative or customs inspection into criminal detention. The first task is to identify the alleged conduct, the quantity or role attributed to each person, any cross-border or online nexus, the current custody status and the evidence already seized. Labels used by police, customs, platforms or media do not settle the offence.

Suspects, families and employers should preserve identity and travel records, device and account data, weighing and identification materials, money-flow records, notices of compulsory measures and a dated chronology of the stop, search or online activity. This guide provides national procedural orientation and does not assess guilt, likely sentence or immigration consequences in a particular case.

Classify the alleged conduct early

Drug cases commonly involve smuggling, trafficking, transporting or manufacturing narcotics; illegal possession; harboring or transferring drugs or proceeds; inducing or allowing drug use; or precursor and related offences. Gambling cases may involve gathering people to gamble for profit, opening a casino, making a living from gambling, organizing participation in overseas gambling, or related money-flow and technical assistance. Administrative punishment for drug use, public-security gambling measures and criminal investigation are different tracks and may coexist.

Narcotics offences and quantity evidence

Under the Criminal Law, smuggling, trafficking, transporting or manufacturing narcotics is punishable regardless of quantity, with higher sentencing bands driven by quantity thresholds, organized roles, armed cover, violent resistance and participation in organized international trafficking. Illegal possession is a separate offence that generally applies where trafficking intent is not established but a quantity threshold is met. The 2016 Supreme People's Court interpretation sets or revises quantity and “serious circumstance” standards across multiple drug types and related offences. Preserve every weighing, sampling, sealing, custody and identification record rather than arguing from a summary figure alone.

Subjective knowledge, roles and common proof issues

Defence review often turns on whether the person knew the substance or package was narcotics, what role each participant played, and whether the quantity, purity and chain of custody support the charged band. Concealment methods, false declarations, flight, discarded packages, coded communications and abnormal money flows are frequently used to infer knowledge, but they still require case-specific proof. Distinguish courier, warehouse, financial, manufacturing and organizing roles. Do not destroy devices, transfer disputed funds or coach witnesses.

Drug use, administrative measures and criminal exposure

The Anti-Drug Law separates criminal narcotics offences from administrative handling of drug use. Use or injection of drugs can attract public-security punishment, while voluntary registration or qualified treatment can affect administrative handling. Criminal exposure remains where the facts show trafficking, possession above threshold, harboring, providing drugs or another offence. A urine or hair screen, compulsory isolation for rehabilitation and a criminal case file should be mapped separately so that administrative steps are not mistaken for a completed criminal disposition.

Gambling, online casinos and technical assistance

Criminal Law Article 303 addresses gathering people to gamble for profit, opening a casino and related conduct. Judicial guidance treats establishing a gambling website, acting as an agent that accepts bets, and certain sustained online organizing models as opening a casino. Providing internet access, hosting, payment settlement, software, advertising or member recruitment to a gambling site, with knowledge of its nature, can support accomplice liability. Preserve platform records, chat groups, agency hierarchies, bet ledgers and payment channels. Ordinary recreational play among acquaintances is not automatically a crime, but profit-seeking organization, scale and online control can change the analysis.

Cross-border gaming and organizing overseas gambling

Cross-border exposure may arise from organizing people to gamble abroad, operating or promoting overseas platforms aimed at people in China, moving funds offshore, or combining gambling with border-control, fraud or money-laundering allegations. Criminal Law Amendment XI added organizing participation in overseas gambling as a distinct offence. Earlier gambling interpretation also addresses certain offshore organizing aimed mainly at Chinese citizens. Identify the place of organizing acts, the location of servers or agents, the nationality and residence of participants, the fund path and any border-crossing or immigration measure. Do not assume that conduct outside mainland China is automatically beyond PRC criminal reach.

Custody, search, devices and money flows

These cases often begin with a stop, search, customs inspection or online-fund freeze and move quickly to criminal detention. Record the legal basis for every search, seizure, freeze, summons, detention, bail or arrest decision. Preserve original phones, computers, account credentials, transfer records and packaging. Families should retain notices and avoid contacting witnesses or moving property in ways that may be treated as interference or harboring. Foreign nationals should also track consular-notification and immigration issues on the foreign-nationals route.

Connected offences and overlapping measures

The same facts may engage money laundering, harboring proceeds, illegal border crossing, fraud disguised as gambling, or assistance to information-network crime. Administrative licence, entry-exit and workplace consequences can continue even while the criminal case is pending. Map each desired outcome—release from custody, return of devices or funds, challenge to an administrative measure, or defence on the merits—to its proper procedure.
