Construction quality in China is governed by mandatory standards, statutory duties and the project contracts. Employers, surveyors, designers, contractors, supervisors and testing bodies have distinct responsibilities. Contractual completion, physical handover, statutory completion acceptance and filing are related but not interchangeable milestones.
When a defect appears, protect people and property first, then preserve the condition before destructive investigation or repair. Identify the applicable standard, design requirement, responsible work package, acceptance history and warranty position. A clear notice and repair process is especially important under the Supreme People’s Court’s 2026 construction-contract interpretation.

Map duties and standards
Identify the employer, survey, design, contractor, supervisor, testing institution, suppliers and users. Build a hierarchy of mandatory standards, approved design, specifications, manufacturer requirements and contract criteria. A contractual tolerance cannot excuse noncompliance with a mandatory safety or quality standard.
Quality planning and traceability
Preserve approved drawings, method statements, inspection plans, samples, material certificates, batch and serial data, test reports, concealed-work records, supervision instructions and nonconformance reports. Traceability should connect each installed element to approval, delivery, inspection and test evidence.
Inspection during construction
Use witness and hold points for foundations, structure, waterproofing, fire systems, utilities and other critical work. Record notice, attendance, result and release. Do not cover rejected or uninspected work without the documented process; photographs alone may not establish compliance.
Classify the defect
Define location, manifestation, severity, progression and affected function. Distinguish design error, material defect, workmanship, interface failure, operation or maintenance, external event and normal wear. Assess immediate safety, consequential damage and whether investigation will alter evidence.
Notice and opportunity to repair
Give a precise notice identifying the defect, supporting records, required protection, access and a reasonable repair period. Under the Supreme People’s Court’s Interpretation (II), effective June 30, 2026, an employer generally cannot require advance payment of repair costs without first notifying the contractor; reasonable repair cost may be recovered after refusal or failure to repair within a reasonable time.
Investigation and expert evidence
Agree an investigation protocol where possible. Define questions, sampling, destructive tests, custody, laboratories, access and reinstatement. Preserve original samples and raw data. Separate factual observations from causation and allocation opinions, and test proposed repair against the governing standard.
Correction, rework and mitigation
Set an approved repair design, safety method, programme, inspection points and acceptance criteria. Record emergency mitigation and why it could not await the ordinary process. Track access, disruption, betterment and consequential cost so the reasonable repair amount can be distinguished from unrelated upgrade.
Completion and statutory acceptance
Reconcile contractor completion, testing, punch-list work, handover, statutory completion acceptance, filing and commercial operation. The Civil Code requires timely acceptance against drawings, instructions, national acceptance norms and quality standards. Use before acceptance can affect claims but does not eliminate responsibility for foundations and main structure within their reasonable service life.
Acceptance disputes and incomplete work
Record whether the work is capable of acceptance, what failed, whether correction is possible and who delayed testing or acceptance. Preserve submission of the completion report and employer response. Quality status can affect payment, completion date, termination consequences and priority rights.
Warranty scope and periods
Issue the required quality warranty document and distinguish statutory minima from longer contractual warranties and manufacturer promises. For building work, minimum periods vary by element; foundations and main structure track the design service life, while waterproofing, heating/cooling, installations and decoration have specific minimum rules.
Retention and guarantees
Define the retention or quality-guarantee base, cap, form, reduction and return date. Link release to lawful and objectively verifiable conditions rather than indefinite internal approval. The 2026 Interpretation (II) addresses the return period when a construction contract is terminated and the contractor leaves the site.
Allocation and recourse
Assess employer design or nominated-material responsibility, designer and supervisor duties, main contractor and subcontractor obligations, supplier warranties, insurer notice and contribution. Do not allocate solely from the location of the symptom; interface and causation evidence may identify multiple responsible parties.
