A Chinese civil appeal and a retrial application are different procedural routes. An appeal challenges an appealable first-instance judgment or ruling before it becomes final. Retrial is an exceptional supervision procedure directed at a legally effective judgment, ruling or qualifying mediation document. The first task is to identify the instrument, service date, court, procedural track, appealability and governing deadline.
Obtain the complete court file immediately: pleadings, evidence, hearing records, preservation orders, expert materials, service records and the signed decision. Build a ground-by-ground record linking the requested appellate or retrial relief to the alleged factual, evidentiary, legal or procedural error.
Subject to editorial and legal review. Filing, service and jurisdiction facts can change the available route. Obtain matter-specific advice before any appeal, retrial, enforcement or procuratorate deadline expires.
Classify the decision and route
Confirm whether the instrument is a judgment, ruling, mediation document or enforcement decision; whether it is first-instance or already effective; and whether a special procedure applies. Ordinary civil appeals, retrial applications, third-party revocation actions, execution objections and procuratorate supervision have different conditions. Do not use a retrial application as a substitute for a timely appeal.
Appeal deadlines and filing
Under the Civil Procedure Law, a party ordinarily has 15 days after service to appeal a first-instance judgment and 10 days to appeal an appealable ruling. Different rules may apply to a party without domicile in China and to particular procedures. The 2023 amendments allow an appeal to be submitted directly to the second-instance court or through the original court. Verify service method, receipt evidence, statutory extensions and the court's current filing instructions.
Preserve issues for second instance
Identify each challenged finding, evidentiary ruling, legal conclusion and procedural event. Cite the exact location in the record and explain materiality. Preserve objections at first instance where possible, seek correction of inaccurate hearing records, and retain proof of refused or late evidence. A broad assertion that the judgment is unfair is not an appellate record.
Scope and powers of the appellate court
The second-instance court reviews the appealed requests and relevant facts and law, subject to the governing procedural rules. It may affirm, modify, reverse, remand or otherwise dispose of the matter. Assess whether new claims, counterclaims, settlements or additional parties can be addressed in the appellate process or require another proceeding.
New evidence and fact development
Explain why any new evidence was not presented earlier, how it was obtained, its authenticity and its effect on the result. Preserve native electronic material, metadata, translations and custody. Coordinate expert evidence with the issues actually open on appeal. Late production can affect admission, costs and credibility even where the material is considered.
Retrial is an extraordinary remedy
A retrial application challenges an effective decision on statutory grounds; filing the application does not by itself suspend enforcement. Test each proposed ground against the Civil Procedure Law, such as qualifying new evidence, a material error in the basic facts or application of law, serious procedural irregularity, or another enumerated defect. The retrial court first examines whether to grant retrial; it does not automatically reopen the merits.
Retrial court and timing
Identify the correct court under the current jurisdiction rules, including special rules for decisions of high people's courts and applications that may be made to the original court. The ordinary application period is generally six months from the effective judgment or ruling, with specific statutory grounds measured from when the party knew or should have known of the relevant circumstance. Calculate from the actual provision and facts rather than relying on a generic deadline.
Procuratorate supervision
Where the statutory conditions are met—such as rejection of a retrial application, failure to rule within the prescribed period, or an allegedly clear error in a retrial judgment or ruling—a party may seek a procuratorate recommendation or protest. This is a distinct supervisory route with its own submission, exhaustion and evidence requirements.
Enforcement and preservation
Track the enforcement case separately. An appeal ordinarily prevents a first-instance decision from becoming effective, but a retrial application ordinarily does not stop enforcement unless a competent authority orders otherwise. Consider lawful preservation, security, enforcement objections and settlement while avoiding asset dissipation or conduct that could attract sanctions.
Cross-border cases
Confirm service abroad, translation, notarisation or apostille requirements, authority of representatives, foreign-party appeal periods and recognition or enforcement implications. The 2023 Civil Procedure Law amendments materially revised foreign-related procedure; do not apply domestic assumptions without checking domicile and service.
