Administrative reconsideration is a government review process for challenging an administrative act in China. It can apply when a citizen, company or other organization considers that an act by an administrative authority has infringed its lawful rights or interests. The process is designed to review both legality and appropriateness, but it is not interchangeable with an administrative lawsuit.

The governing framework changed materially with the revised Administrative Reconsideration Law, effective January 1, 2024, and the revised implementing regulation under State Council Order No. 836, effective July 1, 2026. A party should identify the challenged act, date of knowledge or service, competent authority and any rule requiring reconsideration before litigation immediately.

Start with the administrative act and the filing clock

The revised law uses a broad statutory scope. It identifies categories of reviewable administrative conduct and also covers other administrative acts alleged to infringe lawful rights or interests. Common examples include administrative penalties, compulsory measures, licensing and qualification decisions, government-information decisions, failures to perform statutory duties, compensation decisions and certain administrative agreements. Statutory exclusions and specialist rules still matter, so the label placed on a government document does not decide reviewability by itself.

The ordinary application period is 60 days from when the applicant knew or should have known of the administrative act, unless another law provides a longer period. If the authority failed to notify the affected party of the reconsideration right, competent organ and filing period, the calculation may begin when those matters became known or should have become known, subject to the statutory long-stop framework. The law also contains outer limits measured from the administrative act: generally 20 years for an application concerning immovable property and five years for other applications.

These rules contain qualifications for force majeure, other proper reasons for delay, continuing conduct, failure to perform a statutory duty and other situations. Do not assume that an informal complaint, negotiation or petition suspends the filing period.

Check whether reconsideration must come before court proceedings

Some disputes permit a choice between reconsideration and administrative litigation, while others require reconsideration first. The revised law identifies reconsideration-first categories, and other statutes may impose additional specialist requirements. The authority making the act should ordinarily inform the affected party when reconsideration is a required first step. A route analysis should therefore answer three separate questions: whether the act is reviewable, which reconsideration organ has jurisdiction, and whether litigation can begin directly.

Identify the competent reconsideration organ

Jurisdiction depends on who made the challenged act and the legal status of that body. The responsible organ may be a people's government, a State Council department or another organ identified by the revised law. Joint acts, delegated acts, dispatched organs, vertically managed authorities and authorities that have been abolished or whose functions have changed require separate analysis.

Use the reconsideration notice on the challenged document as a starting point, then verify it against the current statute, implementing regulation and any sector-specific rule. Filing with an incorrect body can consume time even where a transfer or guidance mechanism may be available.

Prepare the application and record

An application may be made in writing; where writing is genuinely difficult, the law also provides for an oral application. Current government channels may include in-person, postal and designated online filing. The national administrative reconsideration service platform publishes filing orientation and access to online services, but local and sector-specific instructions should be checked before submission.

A practical application file commonly includes:

  • the applicant's identity or entity-registration materials and authority documents;
  • the challenged decision, notice or evidence of the administrative conduct;
  • proof of service and a dated chronology showing when the act became known;
  • specific requested outcomes and the principal facts and grounds;
  • evidence supporting standing, jurisdiction and the merits; and
  • an explanation and supporting material for any alleged reason that affected the filing period.

Preserve the original document, envelope, electronic delivery record, screenshots from official systems and proof of each submission. Separate evidence existing when the authority acted from material created later.

What happens after filing

The reconsideration organ first examines whether the application satisfies the statutory acceptance requirements. The review may proceed under an ordinary or simplified procedure. The revised framework emphasizes hearing the parties' views; significant, difficult or complex matters may involve a hearing and consultation with an administrative reconsideration committee.

For the ordinary procedure, the statutory decision period is generally 60 days after acceptance, subject to any shorter period prescribed by law. A complex case may be extended by up to 30 days with approval and written notice. A case handled under the simplified procedure is generally decided within 30 days. Time used for specified procedural events may be treated separately under the governing rules, so a calendar should record acceptance, supplementation, suspension, expert work, hearing and service rather than relying on one projected date.

Filing an application does not automatically mean that the challenged act stops being implemented. The statute provides circumstances in which implementation may be suspended. Any request for suspension should address the legal test and practical urgency directly.

Possible decisions and what follows

Depending on the findings and requested relief, the reconsideration organ may maintain, modify, revoke or partly revoke an administrative act; confirm illegality or invalidity; order performance of a statutory duty; order a new act; reject the application or requested relief; or address administrative compensation within the statutory framework. Mediation or reconciliation can be available within lawful limits, but it should not obscure an expiring procedural deadline.

After the decision, the next route depends on the governing law and the form of the decision. Administrative litigation may be available within a separate filing period, while some reconsideration decisions are final by law. Implementation and enforcement questions also differ according to whether the original act was maintained, changed or replaced. 2026 implementing regulation

The revised implementing regulation took effect on July 1, 2026. It adds operational detail on scope, jurisdiction, application-period calculations, acceptance, evidence, hearings, simplified and ordinary procedures, attached review of normative documents, decision standards, performance and supervision. Current work should use this regulation rather than relying on the superseded 2007 text or an older English translation.
