Claiming a Deceased Relative’s Bank Account in China (2026)

A China bank will not open a dead customer’s deposit because you hold the debit card. It wants a China inheritance instrument that names you.

Not legal advice. Banks and payment apps have their own counters. Heirship is the inherit-property page; remittance is the SAFE page.

Direct answer

Prove heirship first, then visit each institution. Bring a notarial inheritance-right certificate or court judgment, death proof, and your identity. There is no foreigner-facing national account search — you query banks you know, and you treat WeChat Pay / Alipay as separate entities. Using the debit card after death is not “practical”; it is a theft / estate fight. Outward remittance is a SAFE file, not something the teller finishes with the release.

QuestionShort answer
Debit card enough? No. Stop using it.
What paper?继承权公证 or judgment naming you.
All banks at once?No national portal. One branch at a time.
WeChat / Alipay?Separate applications.
Then send USD home?SAFE page — second file.

Scope and legal framework

Civil Code succession + notarial practice. The bank is not a probate court. It follows a notarial certificate or a judgment. Same heirship paper as the apartment, different queue.

Commercial bank / payment-institution KYC. Each licensed institution has its own deceased-customer script. Digital wallets are not “the same as the debit card.”

Practical workflow

  1. Notify known banks; do not spend on the card.
  2. Complete heirship on the inherit-property track.
  3. Book each branch and each wallet operator with the same certificate.
  4. If funds must leave China, open the SAFE pack only after release.

Common mistakes

  • Emptying the account “so it does not freeze.”
  • Assuming one bank letter covers WeChat.
  • Starting remittance before the bank has released.

Action checklist

  1. List known banks, cards, WeChat, Alipay.
  2. Stop all payments from those accounts.
  3. Get the China inheritance instrument.
  4. Book each counter separately.
  5. Only then talk SAFE if you must remit.

Practice Note from Charlotte Whitmore: Families are often delayed by months because names on foreign passports do not perfectly match names on old Chinese household registers (hukou), title deeds, or bank records. Reconcile every spelling and character variant—including former married names—before the first notary appointment, and keep the same translation string through Apostille packages, renunciations, and bank remittance files.

FAQ

Common questions

Quick answers for foreign nationals and employers. Rules vary by city and change over time.

Can one child empty the account with a debit card after death?

That is how families create a second lawsuit. Do not.

What if we cannot find all accounts?

Query known banks; a court investigation order is for a lawsuit, not a tourist week. There is no one-stop portal for foreign heirs.
