Start with the current registry: identify the property, owner, secured debt, mortgage scope and rank, seizures, leases and possession. Preserve the loan and security agreements, registration certificate, repayment ledger, default and acceleration notices, valuation, enforcement rulings, auction notices and occupancy evidence. A contractual mortgage is not the same as a registered real-estate mortgage, and priority cannot be assessed from the loan agreement alone.

Preserve originals, authenticated registry results, dated communications and payment evidence. Build separate regulatory, contractual and dispute timelines because an administrative complaint does not necessarily preserve a civil deadline.

Validate the security

Confirm the mortgagor’s title and authority, registered mortgagee, secured maximum or specific debt, property scope, registration date and any amendments. Review land-use restrictions, co-ownership, corporate approvals and prohibited transfers.

Default and enforcement path

Reconcile principal, interest, fees, cure and acceleration. A mortgage may be realized by agreed disposition where lawful or through court procedures. Map litigation, special realization procedures and direct enforcement instruments without assuming every notarized document is executable.

Priority and competing claims

Search earlier mortgages, seizures, taxes, construction-payment priority, leases, consumer purchasers and insolvency. Priority is claim-specific and may turn on registration, possession, payment and statutory conditions.

Valuation, auction and possession

Check the appraisal, reserve price, encumbrance disclosures, tax allocation, occupied status, vacant-delivery promise and auction conditions. A successful bid does not automatically remove every lease, occupant or operational restriction.

Objections and remedies

Track execution notices and short objection deadlines. Owners, buyers, tenants and other outsiders may have different procedural routes. Preserve the written contract, payment, possession and registration evidence required by the 2025 execution-objection interpretation.
