A development’s commercial description does not establish its lawful use or buildable envelope. Start with the parcel, ownership or land-use right, territorial spatial plan and detailed planning conditions, then trace selection, land-use, engineering and rural-construction permissions through completion verification. Match each approval to the actual design and construction.

Preserve originals, authenticated registry results, dated communications and payment evidence. Build separate regulatory, contractual and dispute timelines because an administrative complaint does not necessarily preserve a civil deadline.

Subject to editorial and legal review. Property regulation and procedure vary by asset, locality and transaction date. Urgent preservation, enforcement and limitation issues require specific advice.

Planning hierarchy and conditions

Identify the applicable territorial spatial and detailed plans, mandatory controls and land grant conditions. Check use, floor area, height, density, setbacks, parking, heritage, ecology and public facilities.

Permit chain

Map project approval or filing, site selection where applicable, construction-land planning, engineering planning, construction and specialist permits. Rural projects may require a rural construction planning permit and agricultural conversion approval.

Design changes

Compare approved plans with later design, sale promises and as-built conditions. Determine whether a change required renewed approval, public notice, stakeholder consent or contract disclosure.

Completion and operation

Confirm planning verification, completion acceptance and filing before occupation or operation. A business licence does not cure an incompatible planning use.

Enforcement and remedies

For stop-work, correction, demolition, confiscation or penalty action, verify jurisdiction, evidence, hearing rights, proportionality and service. Neighbours and purchasers may have separate civil or administrative standing questions.
