A military connection does not replace ordinary family law, but it may add special protections and administrative facts. Confirm whether a spouse is currently an active-duty service member, the relevant service period and unit documentation, who seeks divorce, whether consent is given, and whether the statutory serious-fault exception is alleged. Do not apply the active-duty rule merely because someone is a veteran or military family member.
Preserve civil-status, identity, court and administrative documents, dated communications, financial records and proof of service. Protect children’s and health information, and calculate limitation, annulment, reconsideration and appeal periods independently.

Confirm status and scope
Obtain current service-status evidence without seeking operationally sensitive information. Distinguish active duty, retirement, discharge, civilian defence employment and reserve-related status.
Divorce consent framework
Civil Code Article 1081 provides that where the spouse of an active-duty service member seeks divorce, the service member’s consent is required unless the service member has serious fault. Interpretation I explains the serious-fault reference. Analyse who filed, status at the relevant time, consent and pleaded evidence.
Serious fault and safety
Preserve admissible evidence of domestic violence, abuse, abandonment, bigamy, qualifying cohabitation or other serious conduct. Special marriage protection does not remove urgent personal-safety remedies or excuse unlawful conduct.
Property, housing and benefits
Inventory ordinary marital property separately from military pay components, allowances, housing, insurance, demobilization or resettlement benefits and service-linked entitlements. Classification may depend on the benefit, accrual period and governing rules.
Children and family support
Apply ordinary child-interest standards while addressing postings, deployment, residence, communication, schooling and practical care. Military-family protections may also affect employment, housing, healthcare and other administrative benefits.
