A live entertainment project in China must identify the legal organiser before tickets go on sale or artists are announced. The performing group, performance agency, venue operator, sponsor, ticketing platform and production suppliers have different roles. A concert, theatre production, festival, club performance, promotional appearance, livestreamed show and foreign-artist engagement may also follow different approval paths.

Build the compliance file around the specific event. Record the organiser and licence holder, venue, dates, performers and nationalities, programme and lyrics, production plan, ticketing model, audience capacity, advertising, sponsorship, security, fire and emergency arrangements, insurance, rights clearances, contracts, applications, approval documents, changes and settlement evidence.

Decide whether the activity is a commercial performance

The Commercial Performance Administration Regulation applies to live artistic performances presented to the public for profit. Payment may arise through ticket sales, sponsorship, advertising, commercial promotion, paid access or other commercial arrangements. Classify private rehearsals, internal events, charitable performances, livestreams and mixed online-offline formats on their facts rather than their label.

Map every operator

Identify the performing arts group, performance agency, venue operator and event organiser, plus the contracting and payment entities. Verify business registration, commercial-performance licences or venue filings, authorised scope, personnel qualifications and any foreign-investment conditions. A venue or artist contract does not substitute for the organiser's regulatory eligibility.

Event approval and filing

Match the proposed performance to the competent culture and tourism authority and local process. Applications typically require organiser credentials, performer identity, programme information, venue and dates, contracts or authorisations, and other prescribed materials. Do not advertise, sell tickets or materially commit production on the assumption that approval will be granted.

Foreign, Hong Kong, Macao and Taiwan participation

A performance involving foreign or Hong Kong, Macao or Taiwan groups or individuals follows the applicable cross-border approval route. Confirm the eligible applicant, regulatory history, funding, artist documents, engagement contracts, programme and entry/work arrangements. The national service guide identifies provincial cultural authorities as the approval bodies for covered foreign-related performances; local submission mechanics should be checked for each tour stop.

Programme and content control

Submit complete and accurate programme materials and preserve the approved version. Review scripts, lyrics, choreography, costumes, visuals, stage speech, audience interaction, translated materials and encore plans. Establish change control for substitutions, additional pieces, guest appearances and production changes, and give stage management authority to stop departures from the approved programme.

Venue, crowd and production safety

Allocate responsibility for capacity, admission, security, fire protection, evacuation, temporary structures, electrical systems, rigging, special effects, weather and emergency response. The organiser should verify the venue's fire-safety inspection records, security plan and emergency plans and enter a written safety-responsibility agreement. Coordinate any separate public-security, fire, construction or large-event requirements early.

Ticketing and consumer protection

Control the ticket inventory from issuance through admission. Address authorised sales channels, identity requirements, refunds, postponement, cancellation, seat changes, resale controls, accessibility and customer notices. Ensure promotional claims match the approved artist lineup, programme, venue and ticket availability, and reconcile platform data with settlement records.

Artist, agency and production contracts

Contracts should address services, exclusivity, rehearsal, approvals, travel, visas and work permissions, fees, tax, payment currency, image and recording rights, merchandising, sponsorship conflicts, technical riders, conduct, illness, force majeure, cancellation, insurance, confidentiality, indemnities and dispute resolution. Align the contract's change and cancellation provisions with regulatory and ticket-refund obligations.

Copyright, recording and publicity rights

Clear music, scripts, choreography, designs, recordings, images, names, trademarks and promotional assets for live use and any recording, broadcast, streaming, clips or archive exploitation. Identify who may film and distribute the performance and who bears collective-management, neighbouring-rights and contributor-clearance obligations.

Sponsorship, advertising and merchandise

Map sponsor category restrictions, claim substantiation, endorsement approvals, brand placement and category exclusivity. Review merchandise sourcing, trademarks, quality, consumer disclosures and revenue accounting. Keep sponsor activation and influencer content within the approved event facts and applicable advertising rules.

Changes, touring and enforcement

Approval is tied to submitted facts. Assess changes to the organiser, performers, programme, venue, dates or tour locations before implementation, and complete any amendment or filing. Regulatory consequences can include stopping the performance, confiscation, fines and licence consequences. Preserve approvals, inspection records, performance recordings, ticket data and incident logs.
