A disappointing product or inaccurate statement is not automatically consumer fraud. Identify the specific representation, omission or manipulation; who made it and when; what the operator knew; why it mattered to the transaction; the amount paid; and which statutory damages regime is invoked. Preserve original advertisements, product pages, labels, test reports, chats, invoices and delivery packaging.

Preserve originals, serial or batch identifiers, screenshots with metadata, samples under chain of custody, inspection and repair records, medical evidence, complaints and proof of loss. Calendar contractual, statutory, administrative and litigation deadlines separately.

Subject to editorial and legal review. Product, consumer and injury claims are fact-sensitive. Urgent safety, recall, medical, evidence-preservation and limitation issues require case-specific advice.

Separate breach, defect and fraud

Nonconformity can support contract or quality remedies without proving fraud. A fraud claim requires evidence of deceptive conduct and the relevant state of mind under the applicable rule. Plead alternative bases carefully without collapsing their elements.

Consumer-law enhanced damages

Consumer Rights Protection Law Article 55 provides enhanced compensation for qualifying fraudulent provision of goods or services, while knowing provision of defective goods or services causing death or serious health damage has a distinct rule. Calculate the statutory base, minimum and overlap with actual loss precisely.

Food and drug regimes

Food and drug statutes contain separate punitive-compensation frameworks. Product-specific judicial rules may address purchaser purpose, repeated claims and calculation. Do not apply food multiples to ordinary merchandise.

False advertising and platform evidence

Preserve the complete context, target audience, materiality, sales data and attribution. Identify advertiser, seller, publisher, endorser and platform roles. Administrative findings may help but do not automatically establish every civil element.

Defending abusive or fabricated claims

Verify purchase purpose, quantity, evidence integrity, alleged defect and loss. The 2024 implementing regulation excludes compensation obtained by substitution, fabrication, date tampering or invented facts and does not protect extortion. Legitimate claims must not be dismissed merely because a claimant is experienced.
