China’s constitutional and legislative-supervision system is primarily institutional rather than a general judicial process in which an individual asks a court to invalidate legislation. When a rule appears inconsistent with the Constitution, a law or another superior norm, first identify the document, issuing body, legal level, filing-review authority and the concrete conflict.
Preserve the complete official document and publication record, every cited superior norm, the affected decision or enforcement measure and all live case deadlines. A filing-review suggestion may support correction of a normative document, but it does not automatically suspend that document or replace administrative reconsideration, administrative litigation or another remedy against a specific act.

Identify the document and its legal level
Obtain the complete official text, issuing instrument, date, effective status and amendment history. Classify it as the Constitution, a national law, administrative regulation, supervision regulation, local regulation, autonomous regulation, special-zone regulation, departmental or local-government rule, judicial interpretation, or another normative document. Titles alone do not establish rank or authority.
Map the hierarchy and competence
Compare the issuing body’s legislative or rulemaking competence with the subject regulated. Check whether the document conflicts with the Constitution, a superior law or regulation, exceeds delegated authority, improperly reduces rights or adds obligations, departs from statutory procedure, or creates disproportionate measures. Special authorizations and local legislative powers require their own analysis.
Understand constitutional supervision
The National People’s Congress and its Standing Committee supervise implementation of the Constitution under the constitutional allocation of powers. The Standing Committee may annul specified administrative regulations, decisions, orders, local regulations or resolutions that conflict with superior norms. Constitutional questions are addressed through these institutional mechanisms rather than ordinary courts exercising a general power to strike down legislation.
Choose the correct filing-review system
NPC Standing Committee filing review covers categories assigned by the Constitution, Legislation Law, Supervision Law and the 2023 filing-review decision, including relevant regulations and judicial interpretations. State Council filing review governs regulations and rules under the 2024 Regulation on Filing Review of Regulations and Rules. Local people’s congresses and governments operate related systems for documents within their supervision. Identify the legally competent recipient before filing.
Distinguish a review requirement from a review suggestion
Specified state organs may submit a formal written review requirement within the statutory structure. Other state organs, social organizations, enterprises, institutions and citizens may submit written review suggestions concerning covered documents. A suggestion should identify the document and provision, the superior norm, the precise inconsistency and the requested review; it is not equivalent to commencing private litigation.
Prepare a focused submission
State the submitter and contact details, exact document and clause, issuing authority, official source, superior provisions and a clause-by-clause explanation. Describe practical effects without turning the submission into an unstructured merits narrative. Attach a comparison table, clean copies of all texts, translation where useful and evidence that the challenged text is current and actually applied.
Preserve individual remedies separately
If a licence, penalty, enforcement measure, information refusal or other concrete administrative act affects the client, calculate reconsideration and litigation periods independently. Consider whether incidental review of an eligible below-regulation normative document can be requested in administrative litigation. Filing review ordinarily should not be assumed to suspend the document, the specific act or any procedural clock.
Review methods and possible correction
Review bodies use active review, review on request or suggestion, transferred review, special review and coordination mechanisms according to the applicable system. They may communicate with the issuing body, seek explanation, issue review opinions, recommend amendment or repeal, or use formal annulment powers where legally available. Correction often occurs through communication and amendment; not every matter produces a publicly reasoned determination.
Track status and follow-up evidence
Keep proof of submission, transfer, supplementation and response. Monitor amendment, repeal, replacement, interpretation and annual filing-review reports. If the document changes, assess transition rules and whether the claimant still needs relief concerning past application. Do not describe silence or informal correspondence as a legal finding.
