Broadcasting and audiovisual projects in China must be classified before licences or approvals can be mapped. A television channel, programme producer, cinema film, online audiovisual platform, short-video service, livestream, imported programme and private-network service can engage different regulators and approval paths. The business model, operator, transmission method, audience, content type and origin all matter.

Build a rights-and-regulation file before production or distribution begins. Record the contracting entities, ownership structure, platform and technical route, production and distribution roles, script or programme category, contributors, underlying rights, music, advertising, personal information, minors exposure, licences, filings, review decisions, edits and release territories.

Classify the service and content

Separate broadcast radio or television, programme production, film production and theatrical release, public internet audiovisual services, IPTV or other private-network services, livestreaming and user-upload platforms. Then identify whether the material is a film, television drama, web drama, documentary, animation, news, sports, variety, short video, advertisement or another category. Do not assume one permit covers every channel or format.

Map the operator and ownership rules

Confirm which entity produces, edits, integrates, transmits, distributes, hosts uploads and bills users. The Broadcasting and Television Administration Regulation governs broadcast institutions, programme production and transmission, while the internet audiovisual rules impose their own licensing or filing framework and operator conditions. Check foreign-investment restrictions and the current market-access negative list before choosing a joint venture, contractual structure or acquisition target.

Production and distribution permissions

List each activity against its permit, filing or approval: establishing or operating a broadcast institution, producing or dealing in radio and television programmes, providing internet audiovisual programme services, importing or distributing programmes, and operating a cinema or public film screening business. Verify the licence holder, authorised scope, term, premises, responsible personnel and any change-control obligation rather than relying on a group-company permit.

Film and audiovisual review

The Film Industry Promotion Law establishes the film production, distribution and screening framework and requires films intended for public release to meet the applicable review and release requirements. Online dramas and other network audiovisual programmes follow the rules and current regulator processes for their category. Preserve submissions, versions, regulator communications, edit logs and the approved release version.

Online audiovisual platforms

The internet audiovisual rules cover producing, editing or integrating audio-video programmes for public internet delivery and providing upload-and-distribution services. Review licensing or filing status, approved service category, display of licence or filing information, programme retention, content review, takedown and reporting controls. The rules also restrict support services for unlicensed operators and require copyright protection measures.

Content governance and synthetic media

Operate a documented pre-publication and post-publication review system. Allocate responsibility for scripts, finished programmes, titles, thumbnails, comments, user uploads, livestreams and promotions. Network audio-video providers must respond to prohibited information and retain relevant records. For altered or synthetic audio-video, assess applicable identification, detection and user-management duties as well as personality, privacy and intellectual-property rights.

Copyright, talent and underlying rights

Clear the screenplay, source work, archive footage, music composition, sound recording, performance, image, name, trademark, artwork, format and promotional materials for the intended media, territory, term and exploitation methods. Contracts should address ownership, licence scope, moral rights, editing, dubbing, subtitles, publicity, exclusivity, sequel and merchandising rights, approvals, credits, warranties, indemnities and evidence delivery.

Advertising, sponsorship and product placement

Separate editorial content from commercial messaging and identify the advertiser, advertising operator and publisher. Test claims, endorsements, restricted products, audience targeting and platform-specific presentation under the Advertising Law and sector rules. Sponsorship or product placement does not remove advertising compliance or the need to clear brand and content rights.

Children, privacy and platform records

Apply heightened review where minors appear in or are likely to consume the programme. Map collection and use of contributor, audience and account data, especially facial, voice, location and child data. Keep consent, guardian authority, casting, safety, moderation and complaint records aligned with the Personal Information Protection Law and programme rules.

Enforcement and transaction diligence

Regulatory consequences can include correction orders, content removal, confiscation, fines, suspension and licence consequences. For investment, acquisition or distribution deals, verify licences directly, compare actual operations with authorised scope, sample approval records, inspect takedown and complaint logs, review copyright chains, and allocate legacy-content and platform liability.
