Adoption and guardianship are different legal relationships in China. Adoption creates a statutory parent-child relationship through the required conditions and registration; guardianship concerns authority and duties to protect a person who lacks or has limited civil capacity.

For any cross-border matter, identify the child, biological parents, proposed adopter or guardian, nationality, habitual residence, current custody and the intended destination. China changed its intercountry-adoption policy in 2024: foreign adoption from China is now limited to specified relative and stepchild cases.

Classify adoption, guardianship and custody

Determine whether the objective is permanent legal parentage, temporary or continuing guardianship, day-to-day custody, travel consent or recognition of an existing foreign order. These routes have different conditions, authorities, documents and effects. A guardianship document does not automatically create adoptive parentage or immigration eligibility.

Domestic adoption framework

The Civil Code identifies which minors may be adopted, who may place a child for adoption, adopter eligibility, numerical limits and special rules for relatives and stepchildren. Confirm age, marital status, existing children, capacity to raise and protect the child, health, criminal record and required age difference. Spouses generally adopt jointly.

Consent and the child’s views

Identify every person or institution legally entitled to consent and document why the child may be placed. Biological parents generally act jointly, subject to statutory exceptions. Where the child is eight or older, obtain the child’s consent or views as required. Screen carefully for coercion, payment, trafficking risk and conflicts of interest.

Registration and legal effect

Adoption is established through registration with the competent civil-affairs authority. Determine the correct authority from the parties and type of adoption, then obtain the registration certificate and complete household, identity and related updates. A private agreement or long-term care arrangement alone should not be assumed to establish adoption.

Current foreign-adoption policy

China announced in September 2024 that, except for foreign adopters taking a child of a collateral relative within three generations or a stepchild, children would no longer be sent abroad for adoption. The general foreign-adoption registration regulation was revised in December 2024, and detailed 2026 Ministry of Civil Affairs rules govern the remaining relative and stepchild routes. Confirm current eligibility before preparing a case.

Foreign relative and stepchild procedure

The foreign adopter normally proceeds through the competent authority or authorised organisation in the adopter’s country and the designated Chinese organisation. Materials can include the application, birth and marriage records, financial and health evidence, criminal-record evidence, home study, approval or entry-and-nationality evidence, relationship proof and authenticated documents. The adopter and placing party execute a written agreement and attend provincial-level registration as required.

Applicable law and recognition

Under China’s foreign-related civil-relations law, adoption conditions and formalities engage the habitual-residence laws of both adopter and child; effects generally follow the adopter’s habitual residence at adoption. Guardianship applies the law among specified connections that better protects the ward. Separately confirm recognition, immigration, nationality and re-registration in the receiving jurisdiction.

Guardianship appointment and duties

Establish the existing statutory guardian and whether designation, agreement or court appointment is needed. Guardians must act in the ward’s best interests, protect personal and property rights, and respect the ward’s wishes according to age and capacity. Define education, healthcare, residence, travel, property management, reporting and duration.

Documents, authentication and travel

Prepare civil-status certificates, identity and nationality records, custody or guardianship orders, consents, relationship evidence, translations and authentication or Apostille formalities where applicable. Confirm passports, exit, entry, visa, citizenship and consular requirements independently; a PRC adoption certificate or guardianship order does not guarantee travel status abroad.

Disputes and safeguarding

Potential disputes include invalid consent, concealed parentage, registration refusal, competing guardians, misuse of property, removal of a guardian and dissolution of adoption. Where safety is at risk, contact competent child-protection, civil-affairs, public-security, procuratorial or court authorities promptly and preserve medical, school, communication and financial evidence.
