Direct answer

WeChat and email can be contract evidence; they are not automatically a complete contract.

PRC law recognises electronic data as a form of evidence and does not deny legal effect solely because a message is electronic. A WeChat thread can prove offer, acceptance, a variation, a notice or an admission. Courts still test whether the account belongs to the party, whether the chat is complete, and whether the messages show agreement on essential terms. Export the record in a forensically usable way; screenshots alone are a weak file.

4 questions before you choose the route.

This page identifies the right question and evidence. It does not determine the legal outcome on a reader’s facts.

01

What legal fact are you proving?

Formation, variation, notice, waiver or quantum each need a different slice of the thread.

Issue
02

Can you identify the speakers?

Real-name, company WeCom, mobile numbers and who held the device.

Identity
03

Is the record complete?

Export the full thread, including recalls, voice notes and file transfers.

Integrity
04

Did it change a written contract?

Many contracts say variations must be in signed writing. Later WeChat can still matter as performance evidence.

Working rule: Map the regulated role before marketing or launch in China.

Account identity
Is this a personal WeChat, WeCom, or an assistant’s phone?
Attribution is the first authenticity fight.
Recalled messages
Were messages deleted or recalled after the dispute started?
Selective screenshots are discounted.
Essential terms
Do the messages actually agree price, SKU, quantity and delivery, or only ‘OK’?
Vague chats rarely replace a missing essential term.

Common confusions

Questions people ask before they build.

Short answers for orientation. The right result can change with the service model and current rules.

Is a WeChat ‘OK’ a binding contract?

It can be if the thread already contains the essential terms and the speaker had authority. A bare emoji under a changing price list is usually not enough.

Do we need a notary to preserve WeChat?

Not always, but timestamped native export, and in higher-value disputes a notarial or trusted-timestamp preservation, is much stronger than late screenshots.
