Key considerations

The first questions are about urgency, governance and preservation — before collection expands or interviews begin.

  1. Which facts show this is a banking, wealth & investment products question?
  2. Which institution or process should be identified before assuming an outcome?
  3. What evidence should be gathered before contacting counsel?

What this page decides

Do not classify a China financial product by its marketing name. First identify the legal product and every role in the chain: deposit taker, lender, issuer, manager, adviser, distributor, custodian, technology provider and payment provider. A bank deposit, a commercial-bank wealth-management product, a publicly offered fund and a privately offered investment product sit in different rule sets. Distribution is a regulated activity in its own right: an institution that may manufacture or hold an asset does not necessarily have authority to advise on or sell it. Before launch, confirm entity and licence scope, target-investor eligibility, product risk classification, suitability, disclosure, sales-channel controls, custody and money flows, fees and conflicts, data use, complaints and evidence retention.

What is the product in law?A deposit, bank wealth product, public fund, private fund, security and insurance product have different issuers, regulators and sales rules.Document the instrument, return mechanism, asset pool and investor claim.
Who performs each regulated role?Manufacturing, managing, advising, selling, custody, account opening and payment services are not interchangeable permissions.Map each role to a named legal entity and licence basis.
Who may buy it?Investor category, financial condition, experience, objectives and risk tolerance can affect eligibility and the required sales process.Define the target market and exclusion rules before distribution.
How is suitability evidenced?A risk questionnaire alone does not prove product diligence, risk grading, matching, warnings or required confirmations.Preserve the assessment, match logic, disclosures and exception path.
Does a platform or affiliate touch the sale?Lead generation, recommendation, account opening, payment collection and customer service can cross into regulated distribution or create outsourcing risk.Test the actual customer journey and compensation model, not only the contract label.

Scope

What this page owns — and what it does not

Covers the regulatory-perimeter and distribution-control questions for bank products, wealth-management products, securities and public or private investment funds.
Does not determine a specific product's approval, registration, offering eligibility, tax treatment, return, or investor outcome.
Insurance, pensions, trusts, futures and cross-border investment channels require their own current product and licence analysis even when sold through the same institution.
Current regulator rules, self-regulatory rules and product documents must be checked at launch; this page is an issue map, not a substitute for the governing instrument.

Common failure points

Where files usually break

  1. Calling an investment product a deposit, cash-management service or membership benefit without testing its legal substance.

  2. Assuming a bank, securities or fund-management licence automatically authorises every advisory and distribution channel.

  3. Using a generic risk questionnaire without documented product diligence, grading, matching logic, warnings and exception evidence.

  4. Letting staff, influencers or platform prompts imply principal protection, guaranteed return or regulator endorsement.

  5. Paying referral or sales compensation that rewards volume while obscuring conflicts, unsuitable sales or the identity of the regulated seller.

  6. Outsourcing onboarding, recommendation or customer service without access, audit, complaint, data, business-continuity and exit controls.

  7. Failing to preserve the version of disclosures, app screens, recordings, confirmations and product data used for a particular sale.

FAQ

Narrow follow-ups owned by this page

Can a licensed bank sell any investment product?

No. The analysis depends on the product, the bank's approved business, the capacity in which it acts and product-specific distribution rules. Confirm the exact seller, manufacturer and permission basis.

Is a signed risk questionnaire enough to establish suitability?

No. Suitability also depends on knowing the investor and product, assigning defensible risk categories, matching them, giving required disclosures and warnings, controlling exceptions and retaining evidence.

Can an unlicensed platform act only as a referrer?

Possibly, but the actual journey matters. Recommendations, rankings, personalised prompts, account opening, payment collection, negotiation or sales-linked compensation may change the perimeter and must be assessed.

Can sales or technology operations be outsourced?

Some support can be outsourced, subject to applicable rules, but responsibility and regulated judgment cannot simply be contracted away. The licensed institution needs governance, access, monitoring, continuity and exit controls.
