This article explains how originator companies should build a category-style challenge watch under China's drug patent linkage mechanism, including the statutory framework, the forty-five day response window, and the coordination with invalidation and freedom to operate analysis.
The China patent linkage mechanism
China's drug patent linkage system, implemented through the 2021 trial measures, ties the generic drug approval process to the patent status of the originator product. When a generic applicant files for approval, it must make a declaration about the relevant listed patents: whether the patents are invalid, whether the generic does not fall within the patent scope, whether the generic will wait for patent expiry, or whether the generic challenges the patent's validity or asserts non-infringement. The fourth category declaration is the challenge path, and it triggers a response window that forces the originator to act or lose its opportunity to obtain a statutory stay of the generic approval.
The system is designed around speed. The generic applicant publishes the declaration, the originator has a defined period to file a lawsuit or administrative ruling request, and if the originator files, the NMPA suspends the generic approval for a statutory period. If the originator does not file within the window, the generic approval proceeds, and the originator's patent enforcement options are reduced to the ordinary infringement action, which comes too late for the launch. The mechanism therefore converts patent strategy from a quiet background exercise into a calendar-driven series of decisions.

Statutory framework
Patent Law Article 76
The PRC Patent Law, as amended in 2020, Article 76 establishes the statutory basis for drug patent linkage. It provides that where a party has a dispute over the patent status of a drug for which registration is sought, the party may bring an action in the people's court or request an administrative ruling from the patent administration authority, and that the drug regulatory authority may suspend the approval decision pending the resolution of the dispute. Article 76 is the foundation of the entire mechanism, and the specific procedures are implemented through the trial measures and the judicial interpretation.
Implementation measures
The NMPA and CNIPA Implementation Measures for the Early Resolution Mechanism for Drug Patent Disputes, issued on a trial basis in 2021, detail the process. Article 6 requires the generic applicant to declare its position on each listed patent in the application. Article 7 defines the content of the declarations, including the fourth category challenge declarations. Article 8 establishes the response window: where the generic applicant makes a fourth category declaration, the originator may file a lawsuit or request an administrative ruling within forty-five days of the declaration being notified, and the NMPA will suspend the generic approval for a statutory period if the action is filed within the window.
SPC judicial interpretation
The Supreme People's Court Judicial Interpretation on Patent Linkage, issued in 2021, sets out the procedural and substantive rules for the linkage litigation, including the standing of the parties, the scope of the claims and the standards for the suspension decision. The interpretation confirms that the linkage action is available to the originator and the generic applicant, and that the court will examine both the validity issues and the infringement issues relevant to the declaration.
Enforcement context: Chugai v. CTTQ
The first drug patent linkage lawsuit in China was Chugai Pharmaceutical v. CTTQ, decided by the Beijing Intellectual Property Court in 2022. The case defined the evidentiary standards for originators challenging generic fourth category declarations, including the burden of showing that the generic product falls within the scope of the listed patent and the standards for the validity challenge. The case confirmed that the linkage action is a real and usable tool, and that the courts will engage with the substantive patent questions rather than treating the mechanism as a procedural formality. For originators, the lesson is that the response window is not a deadline to be met with a placeholder filing; the filing must be supported by the evidence and the theory that the court will actually examine.
Building the challenge watch
The practical deliverable is a minimum watch stack that originators should maintain for each franchise product. The stack has four components.
Listed patents maintained with commercial accuracy
The originator should maintain a current list of the patents listed for each product in the China drug registration platform, and the list must be commercially accurate: patents that cover the marketed formulation, the relevant indication or the key process, not every patent in the family. A listed patent that is commercially irrelevant invites a declaration that the originator cannot defend with enthusiasm; a commercially critical patent that was never listed cannot be enforced through the linkage mechanism at all. The maintenance function should be assigned to an owner who monitors the platform and updates the list on a defined cadence.
Competitive filing intelligence tied to declaration types
The watch should track generic applicants for the same product, their approval filings and their declaration types. The intelligence should be tied to the declaration categories, because the response differs by category: a fourth category challenge requires the forty-five day response, while a first category declaration claiming the patents are invalid requires a validity review rather than an infringement action. The intelligence function should combine public regulatory data, market intelligence and counsel review.
Pre-built infringement and validity packages
For each listed patent, the originator should maintain a pre-built package: the infringement analysis with the claim chart, the experimental plan for the infringement demonstration, and the validity defence outline with the prior art positions. The packages are the difference between a response within the window and a panic filing. The technical team should update the packages whenever the patent or the generic landscape changes.
Settlement playbook with anti-monopoly and tender optics
The originator should prepare a settlement playbook that survives the scrutiny of the anti-monopoly authorities and the public procurement context. A settlement that exchanges payments for delayed generic entry can raise anti-monopoly questions, and the playbook should anticipate the review. The settlement options should be priced against the commercial value of the exclusivity period, and the decision framework should be documented so the company can explain why it accepted or rejected a settlement.

The forty-five day tactical response calendar
When a fourth category declaration is published, the originator should execute a defined calendar. Day one to five: confirm the declaration, identify the affected listed patents, and convene the response team including the patent counsel, the regulatory team and the commercial team. Day six to fifteen: complete the infringement and validity assessment against the pre-built packages, decide the response theory, and prepare the evidence. Day sixteen to thirty: draft the complaint or the administrative ruling request, complete the internal approvals and prepare the supporting evidence. Day thirty-one to forty-five: file with the Beijing Intellectual Property Court or request the CNIPA administrative ruling, and notify the regulatory team to track the NMPA suspension. The calendar should also include the fallback decisions: if the response window is missed, the originator should assess the ordinary infringement action, the invalidation action and the settlement options before the generic approval proceeds.
Coordination with invalidation and FTO
The linkage response should not be siloed from the broader patent strategy. A fourth category declaration is often the first signal of a design-around: the generic applicant that declares non-infringement may have engineered a product that avoids the originator's claims. The originator should treat the declaration as the trigger for a design-around analysis, comparing the generic product description against the claim chart and assessing whether the generic product, if approved, would compete with the originator's franchise. The linkage litigation, the invalidation actions and the freedom to operate reviews should be aligned on the same patent expiry model, including the supplementary protection certificate and exclusivity themes. The coordination prevents the classic failure where the originator wins the linkage case but loses the commercial battle because the generic design-around was never addressed.
The same model should be applied to licensing and business development. A challenge to a licensed product affects the licence value, the milestone payments and the royalty stream, and the licence agreement should anticipate the linkage context: which party responds to the declaration, who pays for the litigation, and how the settlement proceeds are allocated. Originators that integrate the linkage watch with the BD function find that the watch becomes a commercial intelligence tool rather than a compliance burden.
The organizational ownership of the watch is the final piece. A linkage watch maintained by a single patent paralegal will fail when the company needs it; the watch should be owned by a cross-functional committee that includes patent counsel, regulatory affairs, commercial strategy and BD, meeting on a defined cadence and reviewing the declaration pipeline as part of the regular product review. The committee should maintain the tracking ledger that records each listed patent, each generic filing, each declaration and each response decision, so that the company can reconstruct its own history at any time. When the watch is institutionalized in this way, the forty-five day window becomes a manageable process rather than a crisis, and the originator is positioned to make the deliberate commercial choices that the linkage mechanism is designed to force.
