Matter routing

Map the place, responsible operator, hazard, response, and injury

Public-place liability is not established by an injury occurring somewhere open to the public. Counsel should identify whether the site and defendant fall within an operator, manager, or event-organizer safety duty; what risk was reasonably foreseeable; which inspection, warning, crowd-control, maintenance, security, rescue, or other measure was required; and whether a third party, the injured person, a product, premises defect, employment relationship, or government function changes the liability route.

Questions that change the route

Who controlled the place and the relevant risk?
Identify owner, tenant, operator, property manager, contractor, security provider, event organizer, platform, public authority, and any third party; map contracts, areas of control, opening status, admission, staffing, and responsibility for the exact condition or activity.
What happened before, during, and after the incident?
Reconstruct the hazard or third-party act, lighting, weather, surface, equipment, barriers, warnings, capacity and crowd flow, inspection and cleaning, prior complaints or incidents, staff response, emergency aid, reporting, repairs, and preservation steps.
Which losses and other liability routes apply?
Separate medical and rehabilitation loss, disability, income, care, property, death and funeral claims, and mental harm; test third-party tort, product, transport, workplace injury, consumer contract, insurance, administrative, and criminal overlaps.

Evidence to organize first

  • CCTV and original export details, photographs, incident and emergency records, access logs, witness details, weather or environmental data, and prompt preservation notices
  • Ownership, lease, management, security and event contracts; risk assessments; inspection, maintenance, cleaning, staffing, training, capacity, warning, complaint, prior-incident, and corrective-action records
  • Medical chronology and records, invoices, disability assessment, employment and income proof, care needs, property loss, insurance correspondence, causation evidence, and damages schedule

Consultation preparation

What to send before speaking with counsel

A focused first message helps a lawyer assess fit, urgency, conflicts, and likely next steps. Prepare:

  • a short summary of the issue and the outcome you want;
  • a dated timeline, including any filing, hearing, termination, or response deadline;
  • the key contract, notice, correspondence, registration, or decision documents;
  • the names and locations of the parties so the lawyer can check conflicts and jurisdiction; and
  • your preferred working language and whether you need an initial budget or fee estimate.

Do not send originals or unnecessary sensitive data before engagement terms and a secure document channel are confirmed.
