Judgment-enforcement formula
The Supreme People’s Court interpretation provides that delayed-performance debt interest consists of ordinary debt interest, if awarded by the effective legal instrument, plus an additional component. The additional component is calculated as:
unpaid qualifying monetary debt × 0.0175% per day × days of delayed performance.
The additional component generally begins when the performance period specified by the effective legal instrument expires and runs until the relevant debt is actually satisfied, subject to rules for partial performance, court realization of assets, suspension periods and other enforcement events.
