Matter routing

Connect the invention, ownership, filing strategy, validity, and enforcement record

A China patent matter should start with the technical and commercial objective, not with a generic request to “protect an idea.” Counsel needs to distinguish invention patents, utility models and designs; identify the real inventors and applicant; preserve confidentiality before disclosure; test service inventions and assignment history; map priority, foreign-filing and translation deadlines; define claim scope against the closest prior art; and plan prosecution, maintenance, freedom-to-operate, licensing, evidence preservation, validity challenges and enforcement as connected workstreams.

Patent searches should follow the technical business, applicant, filing or enforcement evidence, and relevant forum. If you need a patent lawyer in Shenzhen, open the Shenzhen lawyer directory; for Beijing specialist or central-regulatory work, open the Beijing lawyer directory. Confirm current patent experience directly; this directory does not assess validity.

Questions that change the route

What is the protectable subject matter and what has already been disclosed?
Describe the product, process, structure or design, the technical problem and effect, essential and optional features, prototypes and alternatives, closest known references, publications, sales, exhibitions, tenders, investor discussions and confidentiality controls; separate patentable features from software, data, know-how, copyright, trademark and design concerns.
Who owns the application and which filing path protects the business?
Map each inventor and contribution, employer and service-invention rules, contractors and universities, commissioning and collaboration agreements, assignments, funding conditions and chain of title; then calendar China and foreign filings, priority claims, PCT or Paris routes, confidentiality examination where relevant, translations, entity names, divisional strategy, examination requests and fees.
How will scope, validity, use and enforcement be tested?
Build claim charts against prior art and the accused or planned product; review prosecution history, amendments, equivalents and estoppel, licences and encumbrances, annual fees, patent evaluation reports where relevant, invalidation exposure, manufacturing and sales evidence, online and customs evidence, preservation, technical appraisal, remedies, damages, defences, non-infringement options and design-arounds.

Evidence to organize first

  • Invention disclosure, drawings, source and laboratory records, prototypes, test data, alternatives, design history, prior-art search, disclosure and sale chronology, confidentiality agreements and publication copies
  • Inventor contribution and employment records, contractor and collaboration agreements, assignments and licences, applicant and group chart, funding terms, priority documents, foreign-filing instructions, translations, filing receipts, office actions, amendments and deadline calendar
  • Patent register and complete prosecution file, claims and specification, annuity status, evaluation report where applicable, validity and claim charts, accused or planned samples and process evidence, purchase and online records, technical comparisons, notices, customs or court material, damages and licence data

Consultation preparation

What to send before speaking with counsel

A focused first message helps a lawyer assess fit, urgency, conflicts, and likely next steps. Prepare:

  • a short summary of the issue and the outcome you want;
  • a dated timeline, including any filing, hearing, termination, or response deadline;
  • the key contract, notice, correspondence, registration, or decision documents;
  • the names and locations of the parties so the lawyer can check conflicts and jurisdiction; and
  • your preferred working language and whether you need an initial budget or fee estimate.

Do not send originals or unnecessary sensitive data before engagement terms and a secure document channel are confirmed.

Submit an initial enquiry.
