Flagship orientation

A legal corridor is not a checklist. It is a sequence of connected decisions.

Get the facts into view early, identify where China-side and Colombia advice intersect, then take the route that matches the commercial move—not a generic practice-area label.

Cross-border coordination

Make the handoff visible.

Host-country counsel does not replace China-side advice. The most consequential questions often sit where approvals, capital, governance, and enforcement cross jurisdictions.

China-side counsel
  • ODI, SAFE, and relevant China-side approvals
  • China-parent governance and authority
  • Mainland contracts and onshore implications
  • PRC enforcement or asset questions
Colombia counsel
  • Colombia entity, governance, and transaction documents
  • Employment, immigration, and local contracts
  • Colombia regulation and investment screening
  • Courts, arbitration, and host-country enforcement

Questions at the first call

Practical starting points.

Can a Chinese investor establish or acquire a Colombian company?

Generally yes. The suitable structure depends on the activity, ownership, governance, tax, banking, investment registration, sector restrictions, competition review, land, workforce, licences, and other project requirements.

When is foreign investment registered automatically?

Where qualifying foreign currency is channelled through an authorised foreign-exchange intermediary or compensation account with the required minimum data, the exchange declaration can serve as the investment registration. Other permitted investment origins may require a separate filing.

What should be checked before importing into Colombia?

Confirm RUT registration, classification, valuation, origin, any import licence, technical or sanitary controls, labelling, transport and commercial documents, duties, VAT, customs representation, payment treatment, and records.

What requires early review in an infrastructure project?

Review the procurement or concession framework, project vehicle, land, consultation, environmental and sector permits, financing, tax, customs, labour, integrity, security, contracts, change mechanisms, termination, and dispute forum.
