China Trademark Registration — First-to-File

Mainland China is a first-to-file trademark system. Use in another country, or even use in China without a filing, generally does not beat an earlier CNIPA application except in limited bad-faith and well-known mark settings.

The Trademark Law awards the mark to the first valid CNIPA filer in that class, not to the first user worldwide. Nice Classification and similar-mark searches matter because China examination is class-and-subclass sensitive. Unregistered use can still support passing-off style claims in some cases, but it is a weaker, slower path than a registration. Bad-faith squatters are common; opposition and invalidation clocks are short. Register the Chinese-character version as well as the Latin mark.
