The Trademark Law awards the mark to the first valid CNIPA filer in that class, not to the first user worldwide. Nice Classification and similar-mark searches matter because China examination is class-and-subclass sensitive. Unregistered use can still support passing-off style claims in some cases, but it is a weaker, slower path than a registration.
