Beijing is a national financial-management and technology centre, but a local FinTech programme does not remove national licensing or regulatory-perimeter requirements. Businesses should classify the proposed activity, customer flow, custody, payment and data roles before launching or entering a pilot.
Licensing perimeter
Technology branding does not decide whether an activity is regulated. The product, funds flow, customer promise, credit or payment role, custody and distribution model determine which national regulator and licence may be relevant.
Beijing innovation programmes
Beijing has supported FinTech innovation and regulatory testing. Entry into a demonstration zone or innovation project is not a general licence and does not authorize activity beyond the approved scope.
When to involve counsel
Obtain advice before launch, investment or partnership where the model touches payments, lending, credit reporting, securities, insurance, asset management, virtual assets, customer funds, automated decisions or sensitive financial data.
