Current-law scope and cautions
- The Special Maritime Procedure Law lists maritime claims capable of supporting ship arrest and provides a 30-day arrest period for pre-action preservation unless suit/arbitration is commenced in time.
- The court may order applicant security; there is no universal statutory formula equaling claim amount or a fixed percentage.
- Wrongful arrest can create damages exposure, including maintenance costs, delay loss and costs of respondent security.
