- Pre-litigation behavior preservation follows Civil Procedure Law/IP preservation standards; courts assess urgency, merits, harm, balance of interests and public interest.
- Security is commonly required for behavior/property preservation, but the amount is court-determined rather than a universal statutory percentage.
- Evidence preservation should identify evidence at risk of destruction/loss and why ordinary evidence collection is insufficient.
