If the asset is jointly owned marital property, first separate the surviving spouse's own property. If the figure above is already the deceased's estate, leave 100%. For a simple 50/50 jointly owned marital asset, enter 50%.

First-order heirs / 第一顺序继承人

Each branch receives the share the predeceased child would generally have received.

Second-order heirs / 第二顺序继承人

Used only if there is no first-order heir.

Legal basis

How statutory succession works

First-order heirs are the spouse, children and parents. If any first-order heir inherits, second-order heirs do not inherit. Second-order heirs are siblings and paternal/maternal grandparents. Children include biological, adopted and qualifying stepchildren; parents likewise include biological, adoptive and qualifying stepparents.

If a child dies before the deceased, that child's direct descendants may inherit by representation. If a sibling dies before the deceased and there are no first-order heirs, that sibling's children may represent the sibling. A representative branch generally receives only the share that the represented heir would have received.
