From 1 May 2026, SPC/SPP Interpretation (II) Article 8 states that employee embezzlement and misappropriation of company funds use the corresponding corruption and misappropriation-of-public-funds standards. For employee embezzlement, the general amount references are RMB30,000 / RMB200,000 / RMB3,000,000 for large / huge / especially huge, subject to circumstance-based lower bands. For misappropriation, the entry amount differs by use: RMB50,000 for profit-making or more-than-three-month non-return; RMB30,000 for illegal activity. Higher/serious reference amounts also depend on the use pattern and other circumstances.
