Current-law scope and cautions
- Article 214 changed the prior rule and now permits capital reserve to cover losses after discretionary reserve and statutory reserve are used first.
- Accounting treatment and the “according to regulations” condition for capital reserve should be confirmed with current Ministry of Finance rules and company records.
- If losses remain, Article 225 provides a separate capital-reduction-to-cover-loss route with restrictions.
