Current-law scope and cautions
- For unlawful implementation without restrictive effects, the Anti-Monopoly Law permits a fine up to RMB5 million.
- Where the concentration has or may have restrictive effects, the fine can be up to 10% of the previous year's sales, and SAMR may order restoration/unwind or other measures.
