Refugee & humanitarian status

An asylum or refugee-protection file is not an ordinary visa application. In mainland China, a person who fears serious harm on return should identify immediate safety and removal risks, preserve lawful contact and residence records, and use the current UNHCR China registration channel without assuming that an application grants work rights, travel rights, resettlement or a particular outcome.

First job Identify current immigration status, protection basis and competent authority before assuming ordinary visa remedies apply.

Key considerations

The first questions are about urgency, governance and preservation — before collection expands or interviews begin.

  1. Is the person in mainland China, Hong Kong or another jurisdiction, and are they in immediate danger, detention or removal proceedings?
  2. What serious harm is feared on return, why, and which dated evidence can be preserved safely?
  3. Have UNHCR China and any relevant public-security or exit-entry authority issued a case number, identity document, notice or deadline?

What this page decides

Owner

Mainland China's Exit and Entry Administration Law states that a foreigner applying for refugee status may stay during screening using a temporary identity certificate issued by public-security organs, and that a recognized refugee may stay or reside using a refugee identity certificate. UNHCR China currently instructs a person in mainland China who fears serious harm on return to register with UNHCR and proceed through refugee status determination. Registration begins with identity, China visa and entry records, a current police registration form, contact details and an account of why return is feared. A UNHCR card identifies the holder as under UNHCR protection, but UNHCR states that it is not a passport, travel document or visa. Protection screening must therefore be kept separate from ordinary visa extension, work authorization, overseas resettlement and emergency-response questions.

Facts that change the next investigation route
QuestionWhy it mattersNext route
Is there immediate danger, detention or a removal deadline?Urgent protection and procedural deadlines cannot wait for a routine evidence exercise or ordinary visa appointment.Use safe emergency and specialist channels now; preserve notices, location and a confidential contact method.
Is the person physically in mainland China?UNHCR's mainland registration instructions are location-specific; Hong Kong and other jurisdictions have different procedures.Confirm current location before using any office, form, telephone number or legal route.
Has a protection claim actually been registered? An email inquiry, visa problem or expression of fear is not the same as completed registration or recognition as a refugee.Keep the submission, response, appointment, case number and all issued identity records together.
What does the current document permit?A UNHCR card, temporary identity certificate, visa, residence permit and refugee identity certificate have different issuers and functions.Read the document and issuing authority's instructions; do not infer work, travel, re-entry or residence rights.

Common failure points

Where files usually break

  1. Treating an asylum claim as an ordinary visa-extension application.

  2. Assuming an inquiry or registration automatically means recognition as a refugee.

  3. Assuming a UNHCR card is a passport, visa, travel document, work permit or guarantee of resettlement.

  4. Using mainland China instructions for a person in Hong Kong or another jurisdiction.

  5. Missing police residence registration, document-renewal, appointment or removal deadlines.

  6. Sending sensitive evidence through unsafe channels without preserving a secure copy and a dated index.

  7. Failing to update UNHCR when contact details, address or family composition changes.

Decision map

Keep the question bounded.

  1. Stabilize safety and legal statusRecord present location, safe contact method, dependants, medical needs, passport and visa position, police residence registration, detention or removal status and every live deadline.
  2. Register through the current protection channelFor mainland China, consult UNHCR China's current instructions and submit the requested identity, entry, residence-registration and fear-of-return information through its published channel.
  3. Maintain and escalate the fileKeep contact details and family composition current, renew issued documentation on time, obey reporting requirements and obtain specialist help immediately for detention, removal, family separation or urgent protection concerns.
