Transport regulation & operator compliance
There is no single China transport-operator licence. Road, domestic waterway, international shipping, ports and civil aviation have different operating entities, asset permissions, personnel, safety systems and supervising authorities.
First job Identify operator, mode, licence and local authority.

Key considerations
The first questions are about urgency, governance and preservation — before collection expands or interviews begin.
- What service and transport mode is actually being provided?
- Which legal entity operates, contracts, dispatches and controls the vehicles, vessels or aircraft?
- Which licence, filing, route, asset or personnel approval is questioned?

What this page decides
02
China transport compliance begins with activity and operator classification, not the business's marketing description. Identify each legal entity and determine whether it acts as road or waterway carrier, international shipping or NVOCC operator, port or terminal business, civil-air-transport operator, agent, platform, warehouse or subcontractor. Then match the permission to the actual mode, passenger or cargo service, dangerous-goods status, territory or route, operating assets and qualified personnel. An affiliate's licence, a carrier subcontract or a broad business-scope entry does not automatically authorize the entity performing the regulated activity. After the licensing screen, test safety-management, maintenance, dispatch, insurance, recordkeeping and incident duties under the mode-specific rules.

Which fact changes the next route
Use the fact that changes ownership or urgency to decide the next move.
| Question | Why it matters | Next route |
|---|---|---|
| Which entity controls the regulated operation? | The contracting brand, asset owner, dispatcher and licensed operator may be different companies. | Map legal names, contracts, dispatch control, assets, staff and customer-facing documents. |
| Does the permission cover this exact service and territory? | Mode, route, geography, passenger/cargo type and dangerous-goods activity can change the required authority. | Compare the live operation to every scope field and attached condition. |
| Are the operating assets and people independently compliant? | A company-level permission does not replace vehicle, vessel or aircraft certificates, inspection, maintenance or personnel qualifications. | Build an asset-and-person credential register with expiry and restriction alerts. |
| Is there an incident, inspection or suspension clock? | Safety containment, reporting, preservation and regulator-response steps may outrun an ordinary licence remediation plan. | Open an incident chronology, preserve evidence and assign authority communications. |

Practical workflow
Action, evidence, legal gate, output
| Action | Documents / evidence | Legal gate | Output |
|---|---|---|---|
| Inventory activities and entities | Service catalogue, contracts, invoices, dispatch data, organization and subcontract map | Who actually operates each regulated function | Activity/entity matrix |
| Build the permission register | Licences, filings, routes, approvals, asset certificates and personnel credentials | Correct entity, mode, scope, territory and validity | Permission and gap register |
| Test operational controls | Safety system, maintenance, dispatch, hours, training, insurance, dangerous-goods and emergency records | Documented controls match actual operations | Control findings and owners |
| Respond and prevent recurrence | Inspection notice, incident record, correction plan, regulator submissions and verification | Containment, deadline and authority acceptance | Remediation and monitoring plan |

What to gather before the next call
These items help clarify the file; they are not a legal requirement list.
| Item | Why needed | Who holds it | Risk if missing |
|---|---|---|---|
| Entity and regulated-activity map | Connects each service to the company actually performing it | Operations, legal and finance | A brand or affiliate is mistaken for the licensed operator |
| Licence, filing and route register | Tests authority, scope, territory and current validity | Compliance and local operations | Operations exceed or outlive permission |
| Asset certificates and maintenance history | Show that each vehicle, vessel or aircraft may lawfully and safely operate | Fleet, engineering and maintenance | Entity approval masks an asset-level defect |
| Personnel qualifications and duty records | Evidence competent staffing and operational limits | HR, dispatch and safety | Unqualified or over-limit operation |
| Safety, insurance and emergency records | Demonstrate ongoing operational controls and financial protection | Safety, risk and insurer | A paper licence exists without functioning controls |
| Inspection, incident and remediation file | Controls facts, deadlines, submissions and closure evidence | Response leader and authority liaison | Inconsistent accounts or incomplete correction |
Common failure points
Where files usually break
Treating one affiliate's transport licence as group-wide permission.
Checking the company licence but not route, territory, vehicle, vessel, aircraft or personnel restrictions.
Describing a carrier or NVOCC function as consulting, platform or agency work despite the actual contract and operational control.
Using subcontracting to obscure which party dispatches, accepts cargo or passengers and bears the regulated duty.
Renewing permissions without reconciling them to new services, dangerous goods, locations, assets or ownership changes.
Managing a safety incident as routine correspondence instead of preserving evidence and controlling reporting and correction deadlines.
Decision map
Keep the question bounded.
- Classify the activitySeparate passenger, cargo, dangerous-goods, platform, agency, terminal, warehouse and multimodal functions by road, water, sea or air.
- Match permission to operationsTest entity, scope, territory, route, assets, personnel and current operating facts against the relevant licence, filing and certificates.
- Control safety and regulator responsePreserve dispatch, maintenance, qualification, insurance and incident records; identify the competent authority and any stop, correction or reporting deadline.
