Freight forwarding & logistics
A freight forwarder is not always only an agent. Liability follows the service actually promised and performed, the name and capacity used in the transport documents, custody, instructions and any carrier role assumed.
First job Separate carrier from forwarder roles and collect the transport-document chain.

Key considerations
The first questions are about urgency, governance and preservation — before collection expands or interviews begin.
- Who contracted with whom, and in what stated capacity?
- Who issued each transport document and controlled the cargo when the event occurred?
- Is the immediate problem loss, damage, delay, non-release, charges or a customs hold?

What this page decides
02
In a China freight dispute, the label ‘forwarder’ does not decide liability. An international freight forwarder may arrange services in the customer's name or its own name. If it contracts and performs as an agent, the mandate, instructions and reasonable care are central; if it accepts cargo as carrier, issues its own bill of lading or other transport document, collects freight and undertakes delivery, carrier or NVOCC obligations may apply. For international sea carriage, current rules define NVOCC activity around contracting as carrier, receiving and delivering cargo, issuing transport documents and arranging carriage. Classify the role for each leg before relying on exclusions, liability limits, liens or indemnities.

Which fact changes the next route
Use the fact that changes ownership or urgency to decide the next move.
| Question | Why it matters | Next route |
|---|---|---|
| Whose transport document was issued? | Issuing a house bill or other document in one's own name can evidence a contracting-carrier role rather than pure agency. | Compare shipper-facing and carrier-facing bills, signatures, terms and freight invoices. |
| Where and when did loss, damage or delay occur? | The responsible party, evidence rules and contractual or statutory regime may change across warehouse, road, air, rail and sea legs. | Build a timestamped custody and condition chronology. |
| Why is cargo or the bill of lading being withheld? | Customs control, document conditions, unpaid freight, storage charges and asserted liens are different release disputes. | Demand the written basis, amount, contract clause, holder identity and release conditions. |
| Were notice and insurance steps taken promptly? | Survey access, carrier notices, contractual time bars and coverage conditions can be lost while parties debate fault. | Notify potentially responsible parties and insurers while reserving rights. |

What to gather before the next call
These items help clarify the file; they are not a legal requirement list.
| Item | Why needed | Who holds it | Risk if missing |
|---|---|---|---|
| Booking, instructions and service agreement | Show the promised service, authority and capacity | Customer and forwarder | A principal obligation is defended as mere agency |
| House and master transport documents | Identify contracting and actual carriers and operative terms | Forwarder/NVOCC and actual carrier | The wrong defendant, claimant or liability regime is selected |
| Custody and condition evidence | Locate the cargo event and preserve causation evidence | Warehouse, terminal, carriers, surveyor and consignee | The damaged state or responsible leg cannot be proved |
| Freight, surcharge, storage and demurrage ledger | Separate agreed charges from disputed accruals | Forwarder, carrier, terminal and payer | Release negotiations proceed without a verified amount |
| Notices, reservations and insurance records | Protect claims, survey rights and coverage | Cargo interests, logistics parties and insurers | A notice or coverage deadline expires |
| Subcontract and recourse chain | Preserve recovery against the party performing the failed leg | Forwarder, carriers, warehouse and delivery agents | The customer claim is resolved but upstream recovery is lost |
Common failure points
Where files usually break
Treating every freight forwarder as an agent despite its own bill, freight collection, cargo receipt or delivery undertaking.
Relying on one bill of lading without comparing the house bill, master bill, booking and subcontract chain.
Debating liability while missing survey access, insurer notice, carrier notice or contractual time limits.
Paying or refusing all charges as one block instead of separating freight, storage, demurrage, detention and asserted lien amounts.
Assuming a Customs hold proves breach by the forwarder without identifying who supplied, reviewed and filed the disputed information.
Releasing originals, accepting delivery or repairing cargo without recording reservations and condition evidence.
Decision map
Keep the question bounded.
- Classify every logistics roleSeparate shipper, consignee, forwarder-agent, contracting carrier or NVOCC, actual carrier, warehouse, customs broker and delivery agent.
- Locate the eventReconstruct receipt, consolidation, loading, transshipment, customs, storage, delivery and document-release events with custody and condition evidence.
- Apply the right contract and remedyMatch the identified role and leg to governing terms, notices, limits, lien or release rights, insurance and upstream recourse.
