Matter routing

Design the arbitration from the clause through interim relief and enforcement

Commercial arbitration strategy starts with a valid and workable arbitration agreement, but it should be designed through to the award. Counsel needs to identify the institution or agreed procedure, seat and supervisory court, scope and parties, governing law, language, tribunal formation, applicable rules, consolidation or joinder needs, emergency and court-supported measures, evidence plan, confidentiality, timetable, costs, settlement form, set-aside risk, and enforcement jurisdictions under the Arbitration Law in force since 1 March 2026.

Questions that change the route

What does the arbitration agreement cover and who is bound?
Collect every contract and dispute clause; identify written agreement, institution or procedure, seat, language, governing law, scope, survival, amendments, assignment, affiliates, signatories, non-signatories, multiple contracts, pre-arbitration steps, waiver, court litigation and any validity or jurisdiction objection.
Which tribunal, procedure, and protective measures fit the dispute?
Choose arbitrators and disclosure process; map institution rules, notices, service, claims and counterclaims, consolidation or joinder, document and witness evidence, experts, hearings, translation, confidentiality, data transfer, interim or emergency measures, court assistance, security, timetable, costs and settlement authority.
Where and how will the award be challenged or enforced?
Identify award form and correction needs, seat-court review, preservation already obtained, voluntary compliance, assets and obligors, domestic execution, Hong Kong or Macao arrangements, New York Convention or other treaty route, service and due-process record, public-policy risk, limitation, currency, tax, sanctions, insolvency and parallel enforcement.

Evidence to organize first

  • Complete contract and arbitration-clause matrix, amendments, assignments, corporate and signature authority, notices, preconditions, governing-law and seat analysis, institution correspondence and jurisdiction chronology
  • Pleadings and relief schedule, chronology and issue matrix, preserved documents and data, witness and expert plan, translations, procedural orders, hearing record, interim-measure applications and court decisions, cost and settlement-authority records
  • Signed award and service record, correction or interpretation requests, set-aside and enforcement calendar, asset and entity map, preservation status, certified and translated copies, treaty or arrangement analysis, payment and recovery ledger

Consultation preparation

What to send before speaking with counsel

A focused first message helps a lawyer assess fit, urgency, conflicts, and likely next steps. Prepare:

  • a short summary of the issue and the outcome you want;
  • a dated timeline, including any filing, hearing, termination, or response deadline;
  • the key contract, notice, correspondence, registration, or decision documents;
  • the names and locations of the parties so the lawyer can check conflicts and jurisdiction; and
  • your preferred working language and whether you need an initial budget or fee estimate.

Do not send originals or unnecessary sensitive data before engagement terms and a secure document channel are confirmed.

Submit an initial enquiry.
