Matter routing

Separate the alleged offence, the person’s role, and the digital proof

“Cyber crime” can describe unauthorized system activity, online fraud, illegal use of a network, assisting another offence, personal-information conduct, payment or account activity, data theft, or an ordinary crime committed through digital tools. Early defence work should identify the alleged offence and each person’s actual acts, knowledge, purpose, access, benefit, and relationship to the wider chain before drawing conclusions from accounts, devices, transaction volume, or technical access alone.

Questions that change the route

What conduct and role are alleged?
Map systems, accounts, devices, data, communications, funds, services, dates, locations, counterparties, instructions, permissions, and whether the person designed, operated, supplied, referred, paid, received, or merely had nominal control.
How is knowledge or intent said to be proved?
Separate direct communications and admissions from warning notices, abnormal pricing, repeated activity, account controls, technical capability, avoidance steps, commercial explanations, and facts relating to an upstream offence.
Can the electronic evidence be authenticated and tested?
Preserve original media where lawful, acquisition records, hashes, extraction tools and methods, account attribution, timestamps, time zones, server and platform records, completeness, alteration risks, and the chain from seizure or collection to courtroom presentation.

Evidence to organize first

  • Seizure, inspection, imaging, extraction, hash, backup, freezing, and chain-of-custody records for devices, accounts, cloud data, and platform material
  • Contracts, work instructions, permissions, organizational roles, source code, logs, tickets, invoices, payments, communications, and compliance warnings
  • Person-by-person and transaction-by-transaction chronology showing alleged acts, knowledge, benefit, victims or affected systems, upstream conduct, and alternative explanations

Consultation preparation

What to send before speaking with counsel

A focused first message helps a lawyer assess fit, urgency, conflicts, and likely next steps. Prepare:

  • a short summary of the issue and the outcome you want;
  • a dated timeline, including any filing, hearing, termination, or response deadline;
  • the key contract, notice, correspondence, registration, or decision documents;
  • the names and locations of the parties so the lawyer can check conflicts and jurisdiction; and
  • your preferred working language and whether you need an initial budget or fee estimate.

Do not send originals or unnecessary sensitive data before engagement terms and a secure document channel are confirmed.

Submit an initial enquiry.
