China Five-Star Card: identify a live permanent-residence channel before building the file

The Five-Star Card is permanent residence, not a better work permit, a passport or an automatic reward for time spent in Class A. Start with a named NIA channel and the evidence it currently requires.

Decision guide

Operational orientation · Qualified PRC counsel required for fact-specific decisions

Direct answer

Eligibility begins with a named NIA channel and remains discretionary; years on a work permit are not a permanent-residence clock.

The usual orientation routes are qualifying talent, documented investment, Chinese-citizen family relationships meeting the live marriage and residence requirements, and special or humanitarian cases. Class A can support a talent file but does not convert automatically. Processing can take months to around a year without a guaranteed service level, so keep the existing work and residence status valid until the card is in hand.

Application workflow

Write the channel, assemble the recommendation, then preserve status through review.

The process is evidence-led and discretionary; do not publish a guaranteed completion date.

Time on site

Record talent, investment, family or special eligibility against the current official route. If the sentence cannot be written, do not treat the file as ready.

Continuity rule

Do not give up the current work and residence status merely because the permanent-residence file was accepted. Acceptance is not approval; keep lawful status until the card is issued.

The permanent-residence channel desk

Use the current NIA rules and local administration. Do not substitute an old blog threshold, forum timeline or self-assigned talent label.

Route premise

High-level or otherwise qualifying talent supported through the applicable live channel.

Qualifying investment supported by a documented project and the current legal test.

A genuine qualifying relationship with a Chinese citizen and the years required by the live rule.

A specifically available special, humanitarian or comparable exceptional channel.

What is not enough

Class A status or a senior title alone is not an automatic conversion stamp.

An investment amount copied from an old blog is not a current eligibility determination.

A wedding album or paper marriage does not replace the substantive relationship and time evidence.

General sympathy or long residence does not itself establish a named channel.

Recommendation and evidence file

Each route requires an externally verifiable story rather than self-certification.

Core evidence

Identify the recommending body and evidence connecting the applicant to the current talent route.

Document the project, capital, compliance and any recommending or verifying authority required.

Document the genuine marriage or family relationship and the qualifying years under the current rule.

Identify the exact exceptional provision, competent authority and supporting facts.

One-sentence test

State why this applicant fits the named talent channel and who recommends.

State which current investment channel applies and how the project satisfies it.

State the qualifying relationship and the completed time period.

State the named special route and the facts bringing the applicant within it.

Status continuity while NIA decides

Acceptance of the file is not issuance of permanent residence.

Existing permission

Keep the work permit and residence status valid while the talent file is pending.

Maintain the applicant’s lawful current status and the project’s compliance.

Maintain lawful residence and preserve the continuing relationship evidence.

Maintain the lawful status available under the applicant’s present facts.

Processing expectation

Plan for a months-to-around-a-year band rather than a guaranteed SLA.

Project verification and discretionary review can affect timing.

Relationship and years evidence can require detailed verification.

Exceptional review is fact-specific and should not be forecast as automatic.

What permanent residence does not change

Immigration, nationality, employment and tax are separate legal systems.

Citizenship and work

Permanent residence is not naturalisation and does not erase employment-law obligations.

The card does not convert an investment into citizenship.

Marriage-based permanent residence is not a passport or nationality transfer.

Exceptional permanent residence remains an immigration status, not citizenship.

China tax residence

PR does not freeze or replace the 183-day, domicile or six-year IIT analysis.

Investment and immigration status do not answer worldwide-income taxation.

Family status does not determine tax residence by itself.

The applicant must continue to apply the separate tax-residence tests.

Decision notePermanent residence and China individual income tax residence must be analysed on separate clocks.
Common mistakes

Avoid assumptions that confuse time, status and eligibility.

Each mistake treats permanent residence as automatic when the actual system remains channel-based and discretionary.

01

Quitting after file acceptance

An accepted application does not replace the current work and residence permission.

Status gap
02

Paper marriage timed to a rumour

Family routes require a genuine relationship and the years in the live rule, not a cosmetic file.

Evidence failure
03

Treating Class A as automatic PR

High-end work-permit classification can support recommendation but is not a conversion stamp.

Wrong legal door
04

Using an old investment threshold

Historic blog figures do not establish the current investment channel.

Stale rule
05

Ending the IIT analysis

Permanent residence does not switch off the separate 183-day, domicile or six-year tax tests.

Frequently asked questions

Questions applicants ask before seeking a recommendation.

Permanent-residence rules and recommendation channels can change; confirm current NIA administration.

I am Class A. Do I automatically get the Five-Star Card?

No. Class A may make a talent recommendation easier, but it is not an automatic conversion stamp.

Do four years on a work permit automatically qualify me?

No. Time on a work permit is not itself a limitation period that matures into permanent residence; identify a named channel.

Does permanent residence stop China IIT on worldwide income?

No. Permanent residence is immigration status. Tax residence follows separate 183-day, domicile and six-year analyses.

Is the Five-Star Card Chinese citizenship?

No. It is permanent residence, not a passport or naturalisation.

Maintained immigration and tax route station

Use current NIA materials for eligibility and the maintained guides for work status and the separate tax clocks.

Operations library

Continue into the status or tax workflow that owns the next question.

Permanent-residence eligibility does not replace the underlying work-permit or tax-residence analysis.

Counsel handoff

Escalate when the channel, recommendation or status runway is uncertain.

China immigration counsel should confirm the live eligibility route and local filing practice before the applicant changes employment or status.

No named channel can be statedSeniority, wealth, marriage or time in China is not enough without a current legal route.

A recommending authority is requiredThe recommendation and supporting evidence must be planned before filing.

The current permit expires soonRenewal and permanent-residence workstreams must be coordinated.

Tax planning assumes PR changes residenceImmigration and IIT advice must be separated and reconciled.
